Cancel the ruling that "Diesel" be destroyed, and instead adopted.
The Issue
Breed Specific Legislation is cruel and pernicious in the way in which it is applied. This case as in so many, the dog (a Pit bull "type") becomes the victim, in this case for his owners' alleged criminal record.
Prosecutor Sabrina Robinson, representing Nottinghamshire Police, told magistrates at the hearing: "The police offer no evidence to suggest the dog is of an aggressive nature at the time of seizure and during time in kennels.
"The only issue is whether or not you consider Mr Jones to be a fit and proper person."
Upon hearing of the dog's fate, Janet Wesley, a dog breeder of 40 years, told the Post: "There is no reason for this dog to be put down. Because a young man has a record doesn't mean this dog has to pay with its life.
Dog breeder Ms Wesley said: "The dog could have been put up for adoption, and what's stopping the owner from going out and getting another dog? Why can't Diesel be returned?"
Maria Daines is from Dangerous Dog Act (DDA) Watch, a not-for-profit organisation which gives advice to dog owners affected by the legislation. She said: "It doesn't follow that if a person hasn't had a whiter than white life that they will do bad things with their dog, because sometimes a dog is a person's life – it's the one thing they cherish."
We ask that Diesel's life be spared and that he is given the opportunity for adoption in a loving home where he will be cherished and nurtured given his good nature which from the evidence of the Police themselves is proven beyond doubt.
