issues and no witnesses. However, a group of nine concerned Sumter County residents were in attendance. The merits hearing is rescheduled to reconvene on Wednesday, March 25, 2026, at 10:00 a.m. to receive evidence and hear from witnesses, and continuing Thursday, March 26, 2026, at the call of the Chair at the Public Service Commission, 101 Executive Center Drive, Hearing Room, Columbia,
South Carolina 29210. These hearings are open to the public and Protestants will be allowed to speak. At this time, there is a proposal by attorneys to extend the Commission’s deadline to issue an Order (decision) to June 1, 2026. We will provide an update as soon as the Commission has made their decision concerning this request.

Tentative date for a public hearing that will allow residents to speak is currently scheduled for March 18, 2026 in Sumter County- time and location to be determined. The evidentiary hearing date with the PSC is still to be determined. Proposed dates are March 25, 26, 27, 2026. UPDATE: October 31, 2025 Sumter County requested that the Public Service Commission move the hearing to Sumter County. The PSC board has approved the request. We are waiting on an update for the time and location! Please continue to send in letters of protest! October 16, 2025: The PSC public hearing has been delayed to Tuesday, January 27, 2025 by the request of Treaty Oak Clean Energy. Also, the public can continue to submit protest letters for opposition. Please let others know! UPDATE: October 10, 2025: Treaty Oak Clean Energy along with the private landowners filed an appeal regarding the ZBOA denial with the Sumter County Third Judicial Circuit - Common Pleas - Case Number 2025CP4301084 on 6/13/2025. This appeal was dismissed on 9/25/2025. On September 2, 2025, TOCE filed suit with the Public Service Commission - docket # 2025-253-E - asking for a Certificate of Environmental Compatibility and Public Convenience and Necessity for the Construction and Operation of a 170 MW Solar Facility in Sumter County, South Carolina Pursuant to S.C. Code Ann. § 58-33-10 et. seq. There are currently two scheduled hearings for this matter - December 1, 2025 and December 10, 2025. Sumter County has petitioned the PSC to have these hearings moved to Sumter County. Please submit a letter of protest to the Public Service Commission stating your opposition to The White Palmetto Solar Project in Sumter County. See the link below. This proposal included the establishment of a utility-scale solar energy system, along with reductions in setback areas, which could significantly impact our environment and community landscape. On June 13, 2025, private landowners named in court order case no # 2025-CP-43-1084 and TOCE SC Solar I, LLC (Treaty Oak Clean Energy) filed notice of appeal and request for pre-litigation mediation of the final order of the Sumter County Board of Zoning Appeal denial for application No. BOA-25-14. Sumter County is currently preparing for mediation with the named private landowners and TOCE SC Solar I, LLC. Mediation was held Wednesday, August 13, 2025. No resolution was reached. The denial remains under appeal. We must consider the potential consequences that projects of this magnitude could have on our local ecosystem and community integrity. Solar projects on the industrial/commercial scale, while a source of renewable energy, often require vast amounts of land. The conversion of land in Sumter County for industrial purposes can disrupt local wildlife, alter natural habitats, and change the charm and character of our rural areas. Allowing setback reductions further compounds these risks by bringing the industrial installations closer to residential properties and sensitive environmental areas. Such proximity poses not only visual and aesthetic concerns but also raises potential issues related to noise, traffic during construction, and possible electromagnetic radiation exposure. Moreover, these exceptions challenge the zoning laws designed to protect our community's welfare and the orderly development of our county. Adhering to these regulations ensures that projects are developed in a manner conducive to public health and safety while protecting property values and preserving our natural landscapes. We urge the Sumter City-County to stand firm in support of the community's opposition of these large solar projects. Our community deserves thoughtful, well-planned development that respects our environment and maintains the quality of life for our residents.
