The Issue
Indigenous sovereignty is under attack—again. Two Canadians, Carlo (92) and Jason Montemurro, face charges for supporting Indigenous efforts to establish a sacred cemetery in Niagara Falls.

This isn’t about trees. It’s about power. Niagara Region officials weaponized a by-law to halt sacred land use and punish allies, while non-Indigenous violations go unchecked.

THESE TACTICS WORK IN PUSHING ALLIES AWAY AND DISCOURAGING INDIGENOUS GROWTH.

Why It Matters
Indigenous peoples have the inherent right to govern their lands and ceremonies.
Allies should not be punished for standing in solidarity.
Bureaucracy must not be used as a weapon to suppress Indigenous resurgence.
We Demand
🚫 Drop all charges against Carlo and Jason Montemurro
🗣️ Public explanation from Niagara Region officials
🌱 Respect Indigenous land use and governance
⚖️ Hold bureaucrats accountable for suppressing Indigenous rights

Sovereignty is sacred. Solidarity is not a crime.

Endless red tape. Empty gestures. A nation still unwilling to let go of its colonial past. It's time to expose the enablers and hold opponents of Indigenous rights accountable.

⚠️ A New Twist on Suppression? NOT AT ALL - ITS OLD AND WEL

How the Canadian Government Acts

The Canadian government turns a blind eye to its own laws when applied against Canadians—causing people to doubt the legality of Indigenous sovereignty.

  • It creates unnecessary trouble for good Canadians.
  • It instills fear, anger, and regret in those who choose to help.
  • It punishes solidarity instead of supporting justice.
  • It fosters division rather than reconciliation.

🧠 Why This Petition Matters

Indigenous people who continue to live forcefully under Canada's oppression have endured centuries of injustice—from forced assimilation and land dispossession to cultural erosion. In recent years, the Canadian government has made numerous promises to support Indigenous communities in reclaiming self-government and freedom.

Yet, despite these commitments, many government officials and bureaucrats continue to fail Indigenous peoples—ignoring, undermining, and delaying progress.

This is not just about land. It’s about sovereignty, justice, and exposing the enablers. It’s about holding accountable those who use bureaucracy to suppress Indigenous resurgence.

📊 The Truth Behind the Promises

In 2015, Canada’s Truth and Reconciliation Commission outlined 94 Calls to Action, most of which stress the importance of supporting Indigenous sovereignty and recognizing inherent rights.

But according to the Yellowhead Institute, only a fraction of these Calls to Action have been fully implemented—revealing a gap between rhetoric and reality.

It is imperative to shine a light on these breaches of trust.

📜 Case Summary: The Montemurro Charges13501 Montrose Rd - Charges under Woodland Conservation By-law 2020-79

At 13501 Montrose Rd., Niagara Falls, ON, Indigenous people sought to establish a sacred cemetery. The land was introduced by Carlo Montemurro, a 92-year-old ally, and owned by his grandson Jason Montemurro, who had no involvement in land preparation.

Indigenous representatives cleared tick-infested brush to protect a member with an allergy to a sugar molecule called alpha-gal (short for galactose-alpha-1,3-galactose) life-threatening allergies and prepare the land for sacred use. .

Despite clear communication with The Niagara Region officials, including Dan Root , charges were issued under the Woodland Conservation By-law 2020-79. These charges carry fines up to $40,000 and possible jail time—against both Carlo and Jason, despite their limited roles.

 ⚠️ What This Really Means

This case is not about trees. It’s about how Indigenous people are denied the right to govern their own land.  It’s about how allies are punished.  It’s about how bureaucracy is weaponized to halt Indigenous progress.

💔 The Impact

  • Carlo Montemurro, 92 years old, is being punished for supporting Indigenous sovereignty.
  • Jason Montemurro is being punished for selling land.
  • Indigenous plans for a sacred cemetery were halted, delayed, and nearly destroyed.

We have seen non-Indigenous Canadians cut trees without consequence. But when Indigenous people act, the system responds with threats, fines, silence, and punishment.

🕊️ Saint Kateri Tekakwitha Cemetery: A Sacred Vision Blocked by Bureaucracy

The Region of Niagara not only halted our plans—they tried to permanently destroy them. After months of silence and unjust charges, we are finally moving forward.

Jason has agreed to resell the land under a new agreement. We regret his financial loss and sympathize deeply with both him and Carlo, who were punished simply for supporting Indigenous sovereignty.

We are proud to announce the future home of the Saint Kateri Tekakwitha Cemetery, named in honour of the first Indigenous saint of North America. This sacred ground will stand as a symbol of resilience, remembrance, and resistance.
