No funerals for Qartaba Homes directors unless they pay back customers' funds

The issue

This petition is to put on notice the heirs, friends and potential funeral organisers of Qartaba directors – Kashif Aziz, Wajahat Rana and Khurram Jawaid, that a protest will be planned by Qartaba customers at the funerals of Qartaba directors, unless all the debts owed to Qartaba customers are paid off.

As per Sahih Al-Bukhari Hadith 2295 (Chapter 3 of Book 39), narrated by Salama ibn Al‑Akwa (RA), a dead person was brought to the Prophet ﷺ so that he might lead the funeral prayer for him. He asked: “Is he in debt?” When the people replied in the negative, he led the funeral prayer. Another dead person was brought and he asked: “Is he in debt?” They said: “Yes.” He (refused to lead the prayer and) said: “Lead the prayer of your friend.” Abu Qatadah said: “O Allah’s Messenger ﷺ! I undertake to pay his debt.” Allah’s Messenger ﷺ then led his funeral prayer.

Qartaba customers handed over their hard-earned life savings to Qartaba directors, hoping to get interest free lands and homes as per the contracts. Qartaba directors, on the other hand, used a large portion of these customers funds on their profligate lifestyle of farm-houses, luxury cars and expensive private schools, while also getting loans on interest rates as high as 26%. This shamelessly immoral behaviour of Qartaba directors led to their personal and corporate bankruptcy, leaving their customers no recourse to recover their funds. Qartaba directors purchased lavish properties in the names of their wives and other relatives to save them from the legal reach of their customers and creditors.

Qartaba directors can’t deflect the personal liability of these debts on the pretext that the contracts were made by their companies. As per the Supreme Court of NSW Judgement dated 30 April 2025 (Case number 2024/00244366) and the preliminary reports by the liquidator, the directors have the personal liability for the customers claims. Above all, most of Qartaba customers entrusted their funds to Kashif Aziz, Wajahat Rana and Khurram Jawaid due to their personal relationships with them.
