No Evidence : 33 Years Served Grant Clemency For Javier Yanez

The Issue

To Governor Gavin Newsome,

We respectfully ask you to grant clemency to Javier Yanez, CDCR #J12188.

Javier has been incarcerated for 33 years on a 15-to-life sentence for a crime that occurred when he was just 20 years old. He was not the person who fired the weapon—he was a passenger. The individual who committed the shooting has already been released, yet Javier remains incarcerated.

On February 12, 2026, Javier was denied parole for the fifth time The Board was rushing him through his questions. They did not give him adequate time to answer.   And the D.A. was using a blown up glove or stuffed animal waving goodbye while he was leaving. Basically making fun of him being denied. For a D.A. that is not acceptable. Despite decades of positive programming, rehabilitation, and personal growth, he continues to be denied the opportunity for release. After serving more than three decades, he does not deserve to spend the rest of his life in prison. There's no evidence of Javier Yanez no gun, no fingerprints no witnesses.

During his incarceration, Javier has completed all required programs, participated in self-help groups, earned numerous educational certificates, and continues to further his education, especially in mathematics. He serves as a mentor to others, participates in faith-based activities, and has demonstrated consistent good behavior. He expresses sincere remorse for the loss of life and the pain caused by this tragic event.

Over the years, Javier has also built strong, positive relationships and has become like a family member to those who support him. He has shown accountability, maturity, and a deep commitment to living a responsible and productive life.

After 33 years of incarceration, rehabilitation, and demonstrated change, Javier Yanez has earned a second chance.

We respectfully ask for your compassion and consideration in granting clemency so that Javier can return home and contribute positively to his family and community.
