No Easement Discussion Without Full HOA Vote
The Issue
We are concerned residents of Eastpointe Condominium. Recently, our HOA Board of Governors expressed an intention to grant a land easement to the county without seeking approval from us - the homeowners.
This is not only a violation of our rights as shareholders but also sets a dangerous precedent for future decisions that could impact our community. This decision deeply affects us as it involves our safety, potential fees, and property value.
Homeowners Associations are meant to protect the interests of homeowners. However, in this case, it seems that the rights of the majority are being overlooked. The decision to grant an easement should not be made unilaterally by the HOA Board but should involve a vote by all unit owners as everyone will be directly affected.
We urge for openness in our governing Board's operations and call upon all unit owners to ensure that our Board adheres to their ethical and legal responsibility to all Eastpointe shareholders. We demand that the Board obtain authorization through a majority vote of all Eastpointe HOA shareholders before proceeding with any discussions or plans that involve granting land easements.
Statistics from Community Associations Institute (CAI) show that 89% of residents living in HOAs rated their overall experience as positive. However, this trust can be eroded when boards make unilateral decisions without consulting members. According to a study published by Cornell Law School's Legal Information Institute, "an easement can significantly affect property values depending on its nature and use". Therefore we believe that any decisions regarding land easements must involve all unit owners.
