Revise NYS King's Law on Gold & Silver (Article 7: Mines, Minerals And Metals), Sec​.​80-85

The Issue

This petition goes out to protect those men, all men, who choose to embark on the endeavor of the discovery of gold and silver within the lands of New York State.

The current law, which may be referred to as “The King's Law", prohibits keeping any gold and silver found either on public or private property within the state of New York. That’s right, if you find gold under your porch it belongs to the state under these laws. It's practically immediate and automatic eminent domain, an infringement on the property rights of New Yorkers.


Where did these laws come from? New York’s constitution of 1775, when it was ruled by the Duke of New York, a British king. I would find such laws to be unconstitutional, and inherently in violation of the rights of man, as there is no way they could arrive from the consent of the governed, nor from mans’  inalienable right to life, liberty, and the pursuit of happiness - as they were derived from a king, or what would have been called a tyrant. Understand that these laws come from a period prior to George Washington‘s liberation of New York, in which the last British port left in 1783.


I am asking to repeal or revise this article of the New York Constitution, as it is a violation of man's rights. People may say rights derive from government, others may refer to the constitution and say they derive from the creator, I stand that rights derive from reason towards the necessity of mans’ survival - and therefore we must give men, all men, the right to the discovery of precious metals which are deemed in this country legal tender, and always have been, regardless of such unconstitutional decisions, otherwise. The amendment still stands in our Constitution, article 1, section 10, “No state shall... make anything but gold and silver coin a tender in payment of debts”. The King's Law is depriving the rights of the people of New York from the acquisition of unclaimed legal money and intrinsic value, otherwise.


Beyond the legal ramifications, please, understand the ramifications of people looking for gold for recreational reasons. There is little information on deposits of gold in New York because those deposits have to be reported to the state, and I consider this a deprivation of the life, liberty, and happiness of all New Yorkers that wish to pursue the endeavor. Furthermore, a potential commercial industry is lost.
