The Issue
During a traffic stop in 2017, 18 year-old "Anna" was taken into the custody of two Brooklyn South NYPD detectives, Eddie Martins and Richard Hall. They took the teen into their van and handcuffed her. Then, both men forced her to perform oral sex on them against her will and raped her. Eventually, they dropped her on a corner. Anna went to a hospital where a rape kit was performed, and semen was collected. It matched both men. This is the textbook definition of rape: she did not consent, and she was held against her will. At the time, however, there was a legal loophole in New York State that did not classify nonconsensual sex between police and those in their custody as rape. That has since been changed. But these men are walking around the streets of New York--free to hurt more women. This is the fault of Justice Danny Chun!
Martins and Hall eventually were indicted on 11 charges, including bribery and misconduct. This was reduced from an original 50 charges. The men pled guilty and could have faced up to 7 years in prison each. The district attorney prosecuting the case recommended each man serve a sentence of 1-3 years. In fact, the DA wanted the men to serve time, saying, "For the record, your honor, we do oppose a non-jail sentence." Both men admit that they had sex with her against her will. The facts of the case could not be clearer.
However, the presiding judge, New York Supreme Court Justice Danny Chun, gave them no jail time at all. For their horrible crimes, these men were sentenced to five years probation. In his decision, the judge repeatedly blamed the victim, refusing to call her a victim at all. He said that she was also "guilty" and said that there were "criminal activities on both sides." Anna's only crime was being in a car where there was a small amount of marijuana. In an earlier case, Justice Chun gave probation to a police officer who shot an unarmed Black man, Akai Gurley, in a dark stairwell, after the bullet ricocheted off of a wall. In that case, the officer had his gun drawn and finger on the trigger even though he couldn't see where he was.
Justice Chun will let violent, dangerous men get away with anything as long as they are or were police officers. He refuses to protect the lives and safety of New Yorkers. He must be removed. While he is on the bench, he is a danger to every New Yorker and violates the very notion of equal protection under the law. You must remove him from the bench NOW!
