The Issue

My husband, Richard Rosario, has been incarcerated in a New York State prison for over 18 years for a crime he did not commit.  Although my husband had endured unimaginable pain due to his wrongful conviction our children and I have also shared the brunt of that pain.  My daughter and son have spent monumental days in their lives without their father.  They have spent pivotal moments where a boy needs the discipline and guidance only a man can give a son and the love only a father can share with his daughter.  This was taken away from them. 

No mother should have to bear the burden of having to explain to her children why their father is not coming home.  I have had to bear that burden and suffer the depression, stress and anxiety of having to see my daughter and son growing up missing their father and suffering his absence. 

For years I believed the truth of my husband’s innocence would come out and justice would prevail.  My children and I have been waiting every single day for that justice to occur for the last 18 years, for my husband to come home and this nightmare to end. 

At one point I truly believed that my husbands circumstances was an aberration, an honest error committed against my family that would soon be corrected.  I have since lost all faith in the justice system and I will no longer stay silent. 

Here are the facts regarding Richard’s case:

• Richard was in the state of Florida when the crime was committed
• NYPD and the  Bronx District Attorney did not contact any of the 13 alibi witnesses
• This conviction was based solely on the unreliable testimony of two eyewitnesses.  No physical or biological evidence exist that associated Richard Rosario with the crime or the victim.
• Witness statements were not disclosed which may have proved his innocence in trial 18 years ago

Our family needs your help in getting this petition out to the public in hopes that this will push the Bronx District Attorney and the Supreme Court Judge assigned to the case to do what should have been done over 18 years ago and release an innocent man.  Wrongful convictions could happen to anyone your father, husband, brother, son, mother, sister or anyone of your love ones.  Our voice needs to be heard and justice must prevail.  We ask that you join us and let the system know this is not okay.  Millions of taxpayer dollars should not be spent incarcerating the innocent it should be spent by the criminal justice system in doing their job appropriately and incarcerating those that truly should be in prison.  This is an injustice not only to those who are wrongfully convicted but their families that have to endure the suffering of losing their loved ones to the system and the victim’s families that have to live with the knowledge that there is no closure for their loss.
