The Issue
On December 9, 2015 I recieved a phone call from my neighbors telling me that our dog Tiny, a 10 year old American Bulldog, had jumped out of our yard and was loose. My neighbor said she would catch him and put him in her yard till we got home. Turns out Tiny bit her. She then calls me back, acceptably frantic, with a whole bunch of anger letting me know what Tiny had done. Rio Rancho Animal Control responded to this call. When i arrived, the neighbor wouldn't look at me. Animal Control officer explained to me what she was told had happened. The neighbor told A.C that Tiny jumped out of our yard and into her yard, attacked her dog then attacked them. My heart sank as I heard what was told to A.C. I immediatly realized that i had an app on my phone that records all phone calls!! Relieved to tell the officers this, when they let the neighbor know, she then became silent.
Animal Control contacted me and told me that because Tiny bit the neighbor, it was mandatory he stay in quarentine for 10 days. She then informed me that they were going to submit a petition to court for vicious and dangerous dog. I immediately reminded them that Tiny was not vicious or dangerous. He was merely scared and protecting himseld from being forced into a strangers yard.
Speaking with the A.C. Officer that reported to the call first....remember i have all these phone calls recorded, he clearly stated to me that he didn't feel that Tiny was dangerous or vicious. That they had no problem with him at all. Played catch with him before putting him in quarantine and had no problem getting him into the cage. He explained to me that his supervisor was pressing on him to submit the petition for vicious and dangerous dog. He felt that if he didn't file it that he would lose his job. Again, i have these phone calls recorded.
Several times I called the courts to see if anything had been filed. They said that nothing had and this was the beginning of January 2016. On January 14, 2016, I called A.C. to ask what date they had filed the petition. The supervisor said it was three days after the incident had happened. That would mean that on the 12th of December the petition was supposedly submitted.
After hiring a lawyer and finally having our first court date on March 28th 2016, the findings were that Animal Control hadn't submitted the petition till January 14, 2016. The petition that was submitted was submitted incorrectly. The Judge made these findings and dismissed it.
According to law, if Animal Control doesn't file the petition within 14 days of seizure of the animal, they shall immediately release the dog.
Anyone can look this up: Rio Rancho Municipal Code CHAPTER 90
ANIMALS reads as follows:
90.17 POTENTIALLY DANGEROUS, DANGEROUS, AND VICIOUS DOGS.
(d) If the owner does not admit that the animal is potentially dangerous or dangerous and RRAC does not bring a petition to the court within 14 days of seizure of the animal, RRAC shall immediately release the dog to its owner.
Rio Rancho Animal Control charges $10 fine everyday the animal is there. If they would have followed their own law, Tiny should have been released December 23, 2015, 14 days after seizure. We are now April 15, 2016 and our poor Tiny is still at the Rio Rancho Animal Control and even worse, still in quarantine. I found out 2 days ago that the City Attorney for Rio Rancho P.D. refiled the petition for vicious and dangerous dog. How can they allow this?! Why are they refusing to follow their own ordinances and laws. Why is it that we can read the law and understand it, but those that create and uphold the law can't, don't or just refuse to understand it. Why isn't our Tiny home already.
