Save Kellys Conservation Forest Nelson
The issue
A proposed non-complying development in Enner Glynn threatens the rare and significant natural area known as the Kelly Conservation Forest.
Generations of Nelsonians have enjoyed this special forest in the heart of Nelson City for over 34 years. It is a nationally recognised and award winning project.
The development seeks to subdivide neighbouring land into 6 house lots, more than double the amount permitted under the current zoning (this could escalate to 12 residences if secondary dwellings are permitted). It breaches the minimum lot size for all 6 lots, and places 5 lots in the Landscape overlay (specifically designed to protect the Bishopdale Saddle Area as part of the “visual gateway and transition” considered important to the city - NRMP AP 9.2).
It raises issues of air, noise and water quality, safety issues for fire and gun permits in a rural zone (but in proposed high density housing) and yet for almost a year the Council has continued to process the consent. This is despite Nelson City Council’s own Resource Management Plan not allowing such intensive development in its rural zoning.
Within 180 meters of the proposed subdivision is Gibbons Bishopdale development. In the area of Bishopdale there is a significant number of proposed house sites currently available and under development (over 100 houses in the Vista Drive subdivision and 60 in the Bishopdale Potteries SHA). There is absolutely no actual need for these sections to be developed, other than for the sole benefit of the developer.
6 house lots would mean over 40 additional vehicle movements per day (twice that amount if secondary dwellings are included), past the conservation area and a playcenre along a narrow rural road without footpaths used by families, walkers, cyclists, horse riders, dog walkers, stock and businesses. The road does not met current standards and is not proposed to be upgraded.
The stormwater and wastewater from the development would feed into the forested gully, significantly increasing the risk of landslides on already erosion-prone land.
The development is not a permitted activity, and in its own consent application states “the overall status of the subdivision and its component parts is a non-complying activity under the Nelson Resource Management Plan”.

This is not about anti-development, it is about permitted development that isn't at the expense of our rare conservation areas and rural farms.
Sign this petition to let Nelson City Council know that Nelsonians deserve a say about developments that have an impact on our environment. The community must be an affected party with this development.
Join us to let Council know they should not approve a development that is trying to get around the very rules they have set to preserve the nature of this area.
