The Issue
In 1982, Judge Charles Kaufman of the Third Circuit Court of Michigan deemed that the life of an Asian American man by the name of Vincent Chin was worth only $3000, exactly what he sentenced, without any jail time, Ronald Ebens and Michael Nitz to pay in face of their horrific and racially motivated beating of man they mistook for being Japanese. Now in 2012, Navy Capt. Carrie Stephens has "re-evaluated" the life of another Asian American man to be only worth 30 days in jail and a rank demotion to a position that still carries the words "First Class". Lew, the nephew of CA Congresswoman Judy Chu, committed suicide while serving in Afghanistan on April 3, 2011, following racial bullying by fellow marines who humiliated and abused him by kicking and punching him, throwing sand in his face, forcing him to do push-ups in his full gear, and other attacks against his person and body. When finally it seemed that his killers would be brought to justice in a court martial, Judge Navy Capt. Carrie Stephens said "she found no evidence that Jacoby's abuse of Lew caused Lew to kill himself on April 3, 2011. She said she didn't take the suicide into account when determining the sentence". This is a complete travesty of justice, if there were no link between Jacoby's actions and Lew's death, then why is there a court martial to begin with? Justice has not been served and we have to tell the military and American society that the life of Asian American person is not just worth a 30 day jail sentence, a rank demotion, and no fine. If we cannot get a fair sentencing for this first court martial trial, it can be certain that the following trials will let the perpetrators of Lew's death off the hook. Justice was never served for Vincent Chin, but we can remember his legacy and prevent such miscarriages of justice for all Americans such as Harry Lew and Private Danny Chen.
