Please, Immediately Amend 30-year old Motor Vehicle Act, 1988 & make it a Rule.

The Issue

Dear All,

I need your support for the safety, security and well being of ourselves & our loved ones who travels for work or leisure by road in India. On Christmas eve we lost 2 previous young lives to a massive road accident, a head on collision due to reckless driving , in an hit and run case.

We loose on an average 1.5 lakh lives on road in a year and most of them are the young earning members of the family.

We are living in a legal system which needs an overhaul, a bill is pending with Select committee of Rajya sbaha from August 2017 and the Honorable select committee is busy examining the amendments to a 30 Year old act from more than a year!!!.

We need strict punishment to serial offenders, grave penalties and accountability from the Police to act swiftly in the new regime. Look at a small example, as per the old act the compensation for grave injuries is 12K and for death is 25K , with the amendment we expect this to reach a respectable figure in which a family can survive for few years and a legal system is brought in place to overhaul the complete reforms including licencing and strict measures on violation of the traffic rules.We expect better driving conditions and less accidents due to new legal framework.

The Motor Vehicles (Amendment) Bill, 2016

In the last few years, with growing urbanization and rising incomes, the number of motor vehicles in India has been increasing steadily. The number of registered motor vehicles in India grew by 123% between 2005 and 2013 and the number of road accidents increased by 14%, and road accident fatalities increased by 54%.

An increase in the number of vehicles on roads, along with the absence of a coordinated policy to control the problem has been attributed to an increase in the number of road accidents. With the number of road accidents increasing, the Ministry of Road Transport and Highways appointed the Committee on Road Safety in 2007 (Chair: Mr. S. Sundar) to examine the magnitude of road traffic injuries and fatalities.  The Committee recommended setting up road safety authorities (at both national and state levels). In April 2016, the central government constituted a group of state transport ministers (Chair: Mr. Yunus Khan, Minister for Transport, Rajasthan) to recommend reforms for the road transport sector.  The group recommended that the Motor Vehicles Act, 1988 be amended to address urgent issues related to road safety.

The Motor Vehicles (Amendment) Bill, 2016 was introduced in Lok Sabha on August 9, 2016 by the Minister of Road Transport and Highways, Mr. Nitin Gadkari.  The Bill seeks to amend the Motor Vehicles Act, 1988.  The Motor Vehicles Act, 1988 is the primary central legislation that regulates the licensing and registration of motor vehicles, and drivers.  The Bill seeks to address various issues such as road safety, third party insurance, regulation of taxi aggregators, recall of unsafe vehicles, and compensation for victims in case of road accidents. 

The Motor Vehicles Bill, which aims to usher in far-reaching reforms in the transport sector, was o referred to a 24-member Select Committee of the Rajya SabhaIt also aims at ushering in multi-fold hike in fines for traffic violations, compensation of Rs 5 lakh for grave injuries and proposing steps to check vehicle thefts.The bill, which would amend the nearly 30-year old Motor Vehicle Act, 1988 was passed by the Lok Sabha last year but had got stuck in the Rajya Sabha where the opposition had demanded that it be sent to the Select Committee for proper scrutiny. The parliamentary standing committee had also examined and now the bill is under examination of the select committee.
