Legalize Vehicle Window Tint

The Issue

Fellow Californians, I welcome you to sign this petition.

26708(a)vc-tinted windows... violates 4th amendment rights!

Tinted windows are being used as a pretext for law enforcement to make unreasonable search and seizures with no real probable cause and or reasonable suspicion of criminality and "We the People" must demand a stop... the same officers who take an oath to uphold the Constitution of the United States of America are infringing upon our rights to privacy, security and safety with this issue.

People tint windows for many reasons such as harmful u.v. rays or to keep vehicles cool, but most importantly should be the right to privacy for person, home, papers and effects... one’s private vehicle or personal transportation should clearly fall under person, home, papers and effects and thus expectations of privacy within one’s vehicle should be treated as such. If the excuse is officer safety, then I quote; "They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety." Benjamin Franklin. “Give me liberty or give me death.” Patrick Henry

“26708(a)vc-tinted windows” is a discriminatory Double Standard considering that assembly bill 2660 was amended adding section 26708.7 to the Vehicle Code which states “Notwithstanding any other law, a vehicle operated and owned or leased by a federal, state, or local agency, department, or district, that employs peace officers, as defined by Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2 of the Penal Code, for use by those peace officers in the performance of their duties, is exempt from California law, and regulations adopted pursuant thereto, prohibiting or limiting material that may be placed, displayed, installed, affixed, or applied to the windshield or side or rear windows, commonly referred to as window tinting or glazing.”

26708(a)vc-tinted windows is an unconstitutional law infringing upon American citizens 4th amendment rights to privacy, safety and security in persons, houses and effects... private transportation is private property and this law is unconstitutional! We must take a stand while we still can or fascism may win the hearts and minds of Americans! Window tinting is for safety, security and privacy over and above all other reasons and officers safety does not out way the public's… it’s called “risk of liability!”

I will continue to exercise mine and my families right to safety, security and privacy while inside of my private transportation.

I officially hereby challenge the constitutionality of the law 26708(a)vc-tinted windows!

Nearly half of the nations states have no such law as it is only imposed by the federal government upon states which receive them as mandates along with federal funding… this type of law is not of the people, for the people and by the people of the Great State of California; but is instead an undue and excessive burden causing hardship and paving the way for the tyranny of a rampant police state!
