*AYÚDENME A TRAER A MIS HIJOS A CASA: MÁS DE 1080 DÍAS EN UNA PRISIÓN MEXICANA DE MÁXIMA SEGURIDAD POR UN DELITO QUE NUNCA OCURRIÓ*

Me llamo Morris Roy Lester, tengo 56 años y soy de Glasgow, Escocia.

Llevo más de 1080 días (al 26/08/2023) recluido en la prisión de máxima seguridad "Reclusorio Norte" de la Ciudad de México, debido a una acusación falsa de tentativa de feminicidio presentada por mi exesposa (su séptima denuncia), la cual fue reportada dos meses después de la fecha en que ella afirma que ocurrieron los hechos.

No he recibido ni una sola llamada, fotografía, felicitación de cumpleaños ni mensaje de Feliz Navidad de mis dos hijos británicos, de 10 y 15 años, desde que fui detenido frente a ellos el 26 de agosto de 2023.

*Los hechos documentados:

- Se han presentado 7 acusaciones; las 6 anteriores fueron desestimadas o declaradas infundadas. Un juez advirtió sobre las consecuencias de presentar más acusaciones falsas.

- El mismo despacho de abogados representó a mi exesposa en 5 de las 7 acusaciones falsas y en el caso de derecho familiar.

- Un juzgado familiar de Morelos me otorgó la custodia de emergencia.

- 2 traslados forzosos de los niños, retirándolos del cuidado materno por orden de tribunales de familia y el DIF.

- 2 Alertas Ámber

- 15 recursos legales perdidos por la otra parte.

- Caso fragmentado entre 8 tribunales de familia diferentes en la CDMX.

- 1 investigación abierta por presunta sustracción de menores e incumplimiento de órdenes de restricción y mandatos psiquiátricos.

- A pesar de conservar la custodia legal, tras la segunda Alerta Ámber los niños fueron entregados a un pariente lejano de mi exesposa sin que se realizaran evaluaciones psicológicas, penales o de antecedentes.

- Actualmente, mi exesposa tiene derecho a visitas los fines de semana sin supervisión. Mi solicitud para mantener contacto por videollamada ha sido denegada.

- No existen pruebas; solo hay 4 declaraciones no contrastadas: las de mi exesposa, dos empleados y un amigo.

- La fiscalía se niega a buscar pruebas exculpatorias.

*PLAZO CONSTITUCIONAL: SE HA SUPERADO EL LÍMITE DE 2 AÑOS:*

Según el Artículo 20, Apartado B, fracción IX de la Constitución Mexicana, la prisión preventiva no puede exceder los 2 años, a menos que el retraso sea atribuible a la defensa. Si no se dicta sentencia en un plazo de dos años, el acusado debe ser puesto en libertad para continuar el proceso bajo otras medidas cautelares.

Fui detenido el 26/08/2023. El plazo de dos años venció el 26/08/2025. Llevo ya más de tres años en prisión preventiva sin sentencia.

Sostengo que no se realizó ninguna revisión judicial sobre la continuación de la detención al cumplirse los dos años, y que ningún periodo atribuible a mi defensa justifica dicha prórroga.

Mi exesposa y sus abogados exigen que muera en prisión —pidiendo una pena de 46 años y 8 meses, además de una reclamación de casi 3 millones de pesos— por "un delito que nunca ocurrió".

Un delito que, según expertos independientes, requirió meses de preparación y fue ideado por personas "con conocimiento y comprensión del sistema de justicia y familiar de la Ciudad de México".

Desde mi detención lo he perdido todo: an mis hijos, mi trabajo, mi hogar y nuestros ahorros. Mi madre, de 89 años y residente en Escocia, ha vuelto a hipotecar su vivienda (anteriormente de protección oficial) para mantenerme con vida en prisión.

*Lo que solicitamos:*

1. *Fiscalía de la CDMX:* Reabrir la investigación por sustracción de menores e investigar los presuntos incumplimientos de las órdenes de restricción y de las disposiciones psiquiátricas.

2. *Juzgados de lo Familiar:* Hacer cumplir la orden de custodia vigente, permitir el contacto por videollamada mientras se resuelve el proceso penal y unificar todo el expediente familiar ante un único juez competente.

3. *FCDO / Embajada Británica:* Brindar asistencia consular completa, considerar la remisión del caso al Enviado Especial para Detenciones Consulares Complejas, Sir Alistair Burt, y verificar si se llevó a cabo la revisión prevista en el Artículo 20, apartado B, fracción IX.

4. Exigir al Gobierno y a las autoridades judiciales de México que investiguen mi inocencia.

*HELP BRING MY SONS HOME - 1080+ DAYS IN A MEXICAN MAXIMUM-SECURITY PRISON FOR A CRIME THAT NEVER HAPPENED*

My name is Morris Roy Lester, 56, from Glasgow, Scotland.

I have been held for over 1080 days (26/08/2023) in Maximum Security Prison 'Reclusorio Norte, Mexico City', on a false accusation of attempted homicide made by my ex-wife (her 7th) - reported 2 months after she says it happened.

I have not had a single call, photo, Happy Birthday or Merry Christmas from my two British sons, aged 10 and 15, since I was arrested in front of them on 26 August 2023.

*The facts as documented:*

- 7 allegations made - 6 previous ones all dismissed / unfounded. One judge warned against further false allegations.

- Same law firm represented my ex-wife in 5 of the 7 false allegations and the family case.

- Emergency custody granted to me by a family court in Morelos.

- 2 forced removals of the children from maternal care by Family Courts / DIF

- 2 Amber Alerts

- 15 appeals lost by the other party

- Case fragmented across 8 different family courts in CDMX

- 1 open investigation for alleged child abduction / breach of restraining and psychiatric orders

- Despite my retaining legal custody, after the 2nd Amber Alert the children were handed to a distant relative of my ex-wife with no psychological, criminal or background checks.

- My ex-wife now has unsupervised weekend access. My request for video contact has been denied.

- No evidence, only 4 un-questioned statements from my ex-wife, 2 employees and a friend.

- Prosecutors refusing to seek exculpatory evidence.

*CONSTITUTIONAL DEADLINE - 2 YEAR LIMIT EXCEEDED:*

Under Article 20, Section B, paragraph IX of the Mexican Constitution, pre-trial detention cannot exceed 2 years, unless the delay is attributable to the defence. If no sentence is passed within 2 years, the accused must be released to continue the process under other precautionary measures.

I was arrested on 26/08/2023. The 2-year limit expired on 26/08/2025. I have now been held for over 3 years in pre-trial detention without sentence.

I allege no judicial review of the continuation of detention was carried out at the 2-year mark, and no period attributable to my defence justifies the extension.

My ex-wife and her lawyers are demanding that I die in prison, 46 years 8 months, and a claim for almost 3 million pesos, for "a crime that never happened".

A crime that independent experts state took months to make and was designed by people 'with a knowledge and understanding of the Mexico City Justice and Family Department'.

Since my arrest I have lost everything - my children, my job, my home, our savings. My 89-year-old mother in Scotland has remortgaged her ex-council house to keep me alive in prison.

*What we are asking for:*

1. *Fiscalía CDMX:* Reopen the child abduction investigation and investigate alleged breaches of restraining and psychiatric orders.

2. *Family Courts:* Enforce the existing custody order, allow video contact while the criminal case is pending, and consolidate the entire family file before one competent judge.

3. *FCDO / British Embassy:* Provide full consular assistance and consider referral to the Special Envoy for Complex Consular Detentions, Sir Alistair Burt, and verify whether the Article 20, B, IX review was carried out.

4. Force the Mexican Government and Justice Department to investigate my innocence.
