Modernize Idaho Registry Laws: Pass the Romeo and Juliet Protection Act
The Issue
In Idaho, current sex offender registry laws treat many offenses the same regardless of the circumstances surrounding the case. This means that individuals involved in consensual relationships with someone close in age may still face the same registry requirements as those convicted of violent or predatory sexual crimes.
Situations like these are often referred to as “Romeo and Juliet” cases, where two young people are close in age and the relationship was consensual. Despite the nature of these situations, the law can still require lifetime placement on the sex offender registry.
The consequences of registry placement can extend far beyond the original offense. Individuals placed on the registry often face long-term barriers to employment, housing, education, and stability. These challenges can also affect families and communities.
Many states across the country have recognized that consensual close-in-age relationships should not be treated the same as predatory crimes. As a result, they have adopted legal provisions commonly known as Romeo and Juliet laws, which allow courts to review cases individually and distinguish between predatory offenses and consensual relationships between peers.
Idaho currently does not provide a clear provision allowing this distinction.
The proposed Romeo and Juliet Protection Act would allow courts to evaluate the circumstances of statutory offenses and determine whether registry placement is appropriate. This reform would maintain strong protections against sexual violence while allowing the legal system to apply the law more fairly and proportionately.
This petition calls on Idaho lawmakers to modernize the state’s registry laws by adopting the Romeo and Juliet Protection Act. Doing so would help ensure that registry requirements focus on individuals who pose a genuine risk to public safety while recognizing the important distinctions between different types of cases.
