Midtown - City of Atlanta - Noise Pollution from HVAC Units

The Issue

Dear Midtown and City of Atlanta Community,

As the COVID-19 crisis has changed the fabric of our daily lives, many of us have been impacted and are now forced to work from home. During this crisis, it's important that we focus on all aspects of our health, including our mental health.

Since November 2019, the mental health of my partner and I has been impacted by the nuisance of the HVAC units of both our retail establishment neighbor (Park 27 Korean BBQ) and the Plaza Midtown building HVAC units. 

Unfortunately, after repeated requests to the Plaza Midtown Condo Management Association, HOA, retail operator and retail owner (InvenTrust Properties), nothing has changed and no action has been taken to resolve the noise nuisance. InvenTrust has refused to do anything despite formal notice and the threat of legal action. Both the retail operator and the Plaza Midtown Building are in violation of City Code noted below.

Although City Council Member Amir Farokhi sponsored the legislation above which was enacted to help prevent nuisance from HVAC sound transmission, this is not being enforced after repeated requests with the City of Atlanta Building Department and Atlanta Police Department.
