

Demand to OHCHR to sanction & condemn Aliev's crime against Armenian soldiers and hostages

Dear International Criminal Court,
Nagorno-Karabakh (Artsakh in Armenian) has been going through a war since September 27. The Armenian people face, alone, the Azerbaidjian, helped militarily by Turkey and terrorist mercenaries imported from Syria. From the start, Azerbaidjian did not limit itself to bombarding Armenian military zones. It also targeted all places of civilian housing and infrastructure in the territory. Fortunately, Armenia had the population moved in time, thus avoiding any significant human loss.
Today on the internet, hundreds of videos are published by the Azeris highlighting the tortures made by Aliyev's soldiers on Armenian soldiers and civilians. Azerbaidjian commits war crimes and the perpetrators must be sanctioned and condemned.
- GENEVA CONVENTION RELATING TO THE TREATMENT OF PRISONERS OF WAR is not respected -
We call on the OHCHR to denounce, punish and condemn the crimes of Aliyev's government on Armenian soldiers and civilians and hostages. We demand from Aliyev's government the reparation of this damage to the families of these victims of war crimes.
What a war crime : By war crime, we mean violations of International Humanitarian Law of the Geneva Conventions committed against civilians or enemy combatants during an international or internal armed conflict.
Why is it so important to denounce these violations ? Because those responsible can be prosecuted until the last day of their life. The International Criminal Court (ICC) is a permanent international criminal jurisdiction with a universal vocation. It is responsible for judging people accused of genocide, war crimes, crimes of humanity or crimes of aggression. Those responsible for these violations are none other than Azeri President Aliyev, who not only orders these tortures, but does not condemn them.
GENEVA CONVENTION RELATING TO THE TREATMENT OF PRISONERS OF WAR
TITLE I: GENERAL PROVISIONS
Art.3
In the event of an armed conflict, [...] each of the Parties to the conflict shall be required to apply at least the following provisions: Members of the armed forces who have laid down their arms will be treated with humanity, without any unfavorable distinction based on race, color, religion or belief, sex.
To this end, are and remain prohibited, at any time and in any place:
Attacks on life and bodily integrity, in particular murder in all its forms, mutilation, cruel treatment, torture and punishment, […] and outrages upon personal dignity, in particular humiliating treatment and degrading.
Art.4
For the purposes of this Convention, prisoners of war are persons who belong to one of the following categories and who have fallen into the power of the enemy (members of the armed forces of a Party to the conflict, members of militias and of volunteers, […] members of other militias and members of other volunteer corps, including those of organized resistance movements).
Art.5
This Convention shall apply to the persons referred to in article 4 as soon as they fall into the hands of the enemy and until their final release and repatriation. If there is any doubt as to the belonging to one of the categories enumerated in article 4 of persons who have committed an act of belligerence and who have fallen into the hands of the enemy, said persons shall enjoy the protection of the this Convention until their status has been determined by a competent court.
TITLE II: GENERAL PROTECTION OF PRISONERS OF WAR
Ihlam Aliyev is solely responsible for these war crimes and for the inhuman and barbaric treatment applied to Armenian soldiers, civilians and hostages by his Azeri armed forces. Its orders violate this Geneva Convention.
Art.12
Prisoners of war are in the power of the hostile Power, but not of the individuals or troops who captured them. Irrespective of the individual responsibilities that may exist, the Detaining Power is responsible for the treatment applied to them.
Art.13
Prisoners of war must be treated humanely at all times. Any unlawful act or omission on the part of the Detaining Power resulting in the death or seriously endangering the health of a prisoner of war in its power is prohibited and will be considered a serious breach of this Convention.
No prisoner of war may be subjected to physical mutilation or to medical or scientific experience of any kind which is not justified by the medical treatment of the prisoner concerned and which is not in his interest.
Prisoners of war must be protected at all times, in particular against any act of violence or intimidation, against insults and public curiosity.
Reprisal measures against them are prohibited.
Art.4
Prisoners of war are owed in all circumstances to respect for their person and their honor. Prisoners of war retain their full civilian capacity as it existed at the time they were taken prisoner.
