

Protect Faculty Rights in Private Institutions

Sub: Some comments/suggestions on new education policy which may be useful for quality output from Pvt Universities.
The current scenario for faculties working in most of state-run private College or University is horrible. Where a peon, working in Govt institutions is getting more salary than teachers working in private schools. They are paying very less (20,000 to 35000/- p.m. only) to a high educated faculty. These private Universities had framed their rules regulations, and they do not bother about the guidelines of the regulating body and are not following rules and regulations prescribed by the regulation body like UGC and AICTE. Also, these regulating bodies do not cross check the implementation of specified guidelines. These private institutions are not providing research environment to those who wants to do research. They do not want improvement in academic record of faculties. They deposit original documents till the service of instructors so that no one can move another place and feel like they are in a prison. They deduct one month's equivalent salary as security money which they do not return at the end of service termination of faculties. The service termination rules are not equal for both parties (Institute and faculties). They frames service termination rules like: "if a faculty want to leave the service then he/she has to serve three months notice or pay emoluments equivalent to three months to the institutions whereas Institute will give one month notice to faculty. In 90% cases, faculties are forced to resign instantaneously. According to the Gazette of the institution, any faculty will be appointed on probation for one year or expandable to one more year. But before the next year extension institute has to issue an office order before the expiry of the first year otherwise the faculty will be considered as permanent, and the Institute has to pay salary and all allowances according to UGC guidelines. But none (95% or more) of the private institute do not consider faculties as permanent which results in the economic and mental harassment of faculties.Through this petition, I want to draw the attention of Hon'ble Minister MHRD: kindly cross check that whether these private institutes are following guidelines of UGC and AICTE or any regulating body in ground basis not in documents. The private institutions now days are just like property making shops. They do not bother about the level of education and quality of teaching (that's why they pay less to higher educated faculties or hiring less qualified faculty which is not supposed to appoint on assistant professor grade). I am sure if the private institutions follow prescribed guidelines then all faculties will be able to transfer better knowledge to the students who will play a direct role in the economy of the country.
MHRC, UGC and state government must point out these points:
1. What should be selection criteria of faculties? How the regulating body will determine that the said, University is appointing well-qualified faculties? In 90% case, they select those who wants less salary (due to job crises in govt sector they don't have any option and has a social responsibility to answer their daily expenses, so they agree on less salary) or who does not fulfill the academic qualification. They call for vacancies and shortlist those who are less qualified. How regulating body will determine these issues.
2. What should be the terms and conditions in the appointment letter to be issued by private institutions? (some private universities framed their rules while UGC does not permit such terms and conditions)
3. How long time will a faculty work on the contract basis? (In the Gazette of state-run private Universities it is mentioned that employees will be regular after completion of first year but these properties making shops do not consider them on regular basis. It is also referred to in the Gazette that Private University has to appoint the faculties on a regular basis. However, in an extreme case, they can appoint on contract. The current scenario is just reverse. How regulating body will monitor this issue?
4. What should be the criteria for leave rules for faculties: like duty leaves, medical leaves, maternity leaves. This institution never gives such leaves.
5. What should be service termination rules for the employee? Jaipur National University, Jaipur has framed its rules which are not granted by UGC (RTI No.: F.4-3/2016(CPP-I/PU).
6. How the regulations will monitor the student's teacher ratio. In most of the state-run private universities, they appoint one faculty for 70 to 100 students.
Dear Sir/Madam, these are just basic comments that must be ensured by any regulating body.
