For years, we have fought for the most basic rights: for the right to receive an education, to work, to contract, to marry, to inherit, to simply be recognised as people. We have fought for changes in laws that deny persons with disabilities these rights. When the Government of India through its Governmental-Civil Society Committee came to each of our States, in 2011, to consult with us in our own languages, we were convinced that this was a real desire to know what we required. We participated wholeheartedly in making this law, and seeing our suggestions being incorporated into the Bill that was finalised, we believed that the Government was sincerely listening to us.

 

We could not have been further from the truth. The government has betrayed us. It has introduced a Bill in the Rajya Sabha that has nothing to do with the Bill that was discussed with us, and was put up on government websites. It is trying to pass a Bill that is yet not public, and had to be leaked for us to know that it is different! It has robbed us of our rights in a cloak of secrecy and silence. To seek redress for this betrayal, we are seeking the support of right thinking people everywhere:  in the country and outside; from within the disability sector and outside; from lawyers, actors, doctors, filmmakers, from individuals and groups, in short from everyone.

 

We were promised that discrimination on ground of disability would become a thing of the past. And enhanced protection would be provided to those who faced multiple discrimination of disability and gender, race, caste, region or religion. Instead the government wants to pass a law which explicitly permits discrimination against persons with disabilities in certain (unspecified) situations.

 

We were promised that we will have the freedom to fight for our own rights, to take our own decisions, to do what makes us happy and thus live a life with dignity. We have been given the perpetual fear of being under the tutelage of a guardian over a lifetime if we are not found fit to make joint decisions.

 

We were promised liberty, but they are permitting forced commitment to institutions depending on whether the State thinks one of us poses a threat to herself or to society. For years we have protested this incarceration, but they have decided that they know us and our needs better than we do.

 

We were promised that the coverage of the Bill will not be limited to the government alone but would cover all workplaces, educational institutions, hospitals and healthcare providers, government services, private organizations/bodies/societies and so on.  We have been given a legislation which is only operative on the government. This one especially hurts as we had won from the Supreme Court a judgment which stated that the operation of the 1995 Disability Rights law would extend to both public and private establishments.

 

When breach of trust is not protested against and betrayer is allowed to escape, then betrayals become routine and mistrust rules. What has happened to us today could happen to you tomorrow. We are seeking your support so that this Rights of Persons with Disabilities Bill 2014 does not become law. We seek your support to ask the government to come true to its promise, withdraw the Bill and introduce a robust legislation in accord with the promises it made to us in 2011.
