This petition is to inform the Mobile County Public  School Board of Education & MCPSS Superintendent, Chresal D. Threadgill, implementing mandatory mask in Mobile County schools is a violation of federal law. This serves as notice that the mandate for any individual to wear a mask against COVID-19 for employment or attendance at a university or other institution violates federal law. All COVID-19 masks, whether surgical, N95 or other respirators, are authorized, not approved or licensed, by the federal government; they are Emergency Use Authorization (EUA) only. They merely “may be effective.”
Federal law states:
Title 21 U.S.C. § 360bbb-3(e)(1)(A)(ii)(I-III) of the Federal Food, Drug, and Cosmetic Act (FD&C Act) states: individuals to whom the product is administered are informed-
(I) that the Secretary has authorized the emergency use of the product;
(II) of the significant known and potential benefits and risks of such use, and of the extent to which such benefits and risks are unknown; and
(III) of the option to accept or refuse administration of the product, of the consequences, if any, of refusing administration of the product, and of the alternatives to the product that are available and of their benefits and risks. 
EUA products are by definition experimental and thus require the right to refuse. Under the Nuremberg Code, the foundation of ethical medicine, no one may be coerced to participate in a medical experiment. Consent of the individual is “absolutely essential.” A federal court held that even the U.S. military could not mandate EUA vaccines to soldiers. Doe #1 v. Rumsfeld, 297 F.Supp.2d 119 (2003).

Mobile County parents have the right to make informed decisions on behalf of their children. The MCPSS Board and Superintendent, Chresal Threadgill, must immediately withdraw the mandatory mask wearing in Mobile County public schools and move to making mask wearing OPTIONAL for all students attending Mobile County public schools.
Parents and/or legal guardians are the ONLY ones who have the authority to make informed health decisions for use of EUA products on behalf of their child and/or children. This includes but is not limited to EUA masks, face shields, cloth face coverings, surgical masks and vaccines.   
Mobile County parents have had enough with manipulative and unfounded decisions in regards to COVID-19 and any Variants coming from SARS-CoV-2. There is ABSOLUTELY NO SCIENTIFIC PROOF mask prevent the spread of SARS-CoV-2 or other viruses. An OVERWHELMING amount of gold standard RCT (Randomized Controlled Trials) studies imply face masks ARE NOT EFFECTIVE IN PREVENTING the spread of SARS-CoV-2! 

On the contrary, there IS scientific proof it effects our children’s development mental & physical health! Wearing face masks for 4.5+ hours a day in school has detrimental psychological and physical adverse effects on our children. 

Dangers of prolonged face mask wearing in children-

•Co2 carbon dioxide concentrations (hypercapnia), shortness of breath, perceived exertion, feelings of warmness, rapid heart rate, headaches, lightheadedness, visual challenges, difficulty communicating, high-risk self-contamination behaviors from frequently touching their mask, disruptive breathing patterns, oral health (mask mouth), increase in tooth decay, gum disease, dry mouth, cavities, dehydration, recycling air, rapid shallow breathing, decrease in saliva production, increased acidity of an individual’s oral micro-biome, inflammatory disease.

•Facial recognition plays an important part in the brain. The fusiform face area in the temporal lobe, which is solely responsible for facial recognition.  Kang Lee, head of the Development Lab at the University of Toronto, says humans, as a social species, rely on faces to glean information about emotions and social interactions from quite an early age. That information then helps inform our behavior. Lee says it is a vital part of child development, even at infantile age. There is fluent data regarding the development of a deeper understanding of conditioned fear responses in humans of all ages; however, children are most susceptible to drastic cognitive decline as a result of consistently being in a state of fear and anxiety. According to the National Scientific Council on the Developing Child, “science shows that exposure to circumstances that produce persistent fear and chronic anxiety can have lifelong consequences by disrupting the developing architecture of the brain”. The repercussions have already become evident in schools, where teachers and caregivers have been instructed to wear clear face masks in order to prevent the emotional trauma and limited cognitive development from worsening in young children. The fact that this has been implemented shows that professionals are aware of the psychological HARM which they are inflicting on children by wearing masks. Developmental psychologists state that “masks could delay learning,” and that this crucial reliance on faces and mouths for language development is “a learning tool in the same way that books are” [19]. Removing the ability for children to process faces hinders their development of social cues which is verifiably harmful to them. (Source:

In conclusion, as a parent who’s child suffers from chronic allergies and allergy induced asthma, I cannot and will not allow my child to be forced into actively harming their psychological and physical health based on false and misleading reports on wearing face masks. 

I urge other parents to take the time to research the RCT on the effects of children wearing masks and make an informed decision if it’s in the best interest of their child to do so.
