Subject: A Call for Improved Maternity Leave Policies for NYS Public School Teachers

We are writing to bring attention to an urgent issue regarding the maternity leave policy for Public School Teachers in the state of New York. As it currently stands, the existing policy provides only 6 weeks of maternity leave for natural births and 8 weeks for C-sections, with the requirement to use accrued sick time during this period. If a teacher runs out of sick days, they face going unpaid and being taken off their health insurance, even prior to the conclusion of the 6-8 weeks. Worse still, teachers lose their seniority the moment they go unpaid, and if they go unpaid for 21 days or more, their raises get delayed 6 months for the remainder of their career.

In addition, there is no paternal leave for fathers, as the current policy only allows for up to 3 sick days with penalties (stated above) for any additional time off. This policy fails to recognize the important role fathers play in supporting their families during critical times, such as the birth, care of a child and bonding with their child.

This policy is unjust and needs to be changed. Teachers, who already spend countless hours of their personal time and money to create enriching and effective learning environments for students, deserve better. They deserve support during one of the most significant times in their lives—bringing a new life into the world.

The Problems with the Current Maternity Leave Policy:

Insufficient Time for Recovery: Six weeks for vaginal birth and eight weeks for C-sections are often not enough time for full recovery, especially when teachers are expected to return to work in physically demanding classrooms. This does not allow appropriate time for the mothers to bond with their newborn babies.

Loss of Pay and Health Insurance: Teachers are required to use their sick days, and if they run out, they go unpaid and lose their health insurance and have to pay into a higher premium insurance. This is an undue financial burden for educators who are already dedicating their time and personal resources to their students.

Loss of Seniority: Going unpaid results in the loss of seniority, which affects future career progression, job security, and the quality of life for teachers.

Delayed Raises: Going unpaid for more than 21 days causes raises to be delayed for six months indefinitely, affecting the teacher's financial stability and morale.

Impact on Mental Health and Well-being: The pressure of navigating these policies during an already emotionally and physically challenging time can negatively impact the well-being of teachers.

No Paternal Leave: This policy fails to recognize the important role fathers play in supporting their families during critical times, such as the birth or care of a child. Paternal leave is crucial to ensure a  better support all employees in fulfilling their family responsibilities.


Our Request:
We are petitioning for the following changes to the current maternity leave policy for Long Island public school teachers:

Paid Maternity Leave: Provide a fully paid maternity leave option, ensuring teachers can take the time they need to recover and bond with their new child without financial strain.


Extend Leave Duration: Allow for a minimum of 12 weeks of paid maternity leave, regardless of the type of delivery, to support teachers in their recovery and to ensure adequate time with their newborns.


Protection of Seniority and Raises: Ensure that teachers' seniority is not jeopardized when taking maternity leave and that any raises are not delayed as a result of taking leave.

Paternal Leave: Provide paternal leave for all fathers to enable them to care for their families and bond with their children during this crucial time.
 
Fair Treatment for All Educators: Guarantee that all teachers, regardless of the amount of sick time they have accrued, are entitled to paid maternity leave without financial or career consequences.


Conclusion:
Teachers are the backbone of our education system. They spend their own time and money to nurture the minds of the next generation. It is time that we, as a community, show up for them in their time of need. Our educators deserve maternity leave that provides them with financial security, career protection, and adequate time to recover and bond with their newborns.
