"The Yeshiva is proposed to serve a maximum of 96 students, ranging in age from 18 to 22 years old, which students will live onsite while school is in session. While parochial boarding schools are a conditionally permitted use in the R-4 zone, in which this property is located, one of the conditions of such use is that students may not be 18 years old or older at the beginning of the school year. Additionally, a parochial boarding school is limited, by ordinance definition to grades Kindergarten through Grade 12. Accordingly, Applicant seeks use variance relief pursuant to N.J.S.A. 40:55D-70.d to permit a post-high school boarding school for students ages 18 to 22 on this property."

Those that have signed this petition, as residents of the Township of Ocean, New Jersey, are against the use of this property as requested by Yeshiva Gedolah Na'os Yaakov, Inc.

We are concerned for the well-being of our children and the preservation of our family-oriented community should the addition of almost 100 men be allowed to stay in such close proximity to our homes. The property on Logan Road is not large enough for outdoor recreation for those who would reside there. Dave Dahrouge Park, which is maintained with taxes paid by our residents, would be utilized. Children and their families would be uprooted from a place of comfort and enjoyment because of the sheer volume of people now living in such a small area of our town. The benefits of our neighborhood would no longer be ours.

The R-4 Zone was written a specific way for a reason. We see no benefit in a variance relief, only adverse circumstances. And as stated in 40:55D-70d,

"No variance or other relief may be granted under the terms of this section, including a variance or other relief involving an inherently beneficial use, without a showing that such variance or other relief can be granted without substantial detriment to the public good and will not substantially impair the intent and the purpose of the zone plan and zoning ordinance".
