The Issue
Urgent Petition: Protect Vulnerable Populations in New York State
My name is Janine Hernandez, and I am a survivor of domestic violence.
I’m raising the alarm about a dangerous gap in New York State’s certification standards for sign language interpreters—one that leaves some of our most vulnerable populations at risk.
Shockingly, individuals, including those with violent histories, can work closely with the deaf community and autistic children without being required to meet any state or national certification standards.
THIS. MUST. CHANGE. NOW.
I am calling on you to take IMMEDIATE ACTION to demand a state law requiring certification for all interpreters and professionals in these sensitive roles.
Here’s why this issue is urgent:
In my own experience, a WELL KNOWN ABUSER from Queens, NY—someone we could not criminally convict—has been able to secure employment as a sign language interpreter and an ABA therapist working with autistic children, the deaf community, and even survivors of abuse.
This person has a LONG HISTORY OF ABUSE, including abusing his own MOTHER, who is deaf, and yet there is nothing stopping him or others like him from accessing vulnerable individuals in their workplaces.
The LACK OF MANDATORY CERTIFICATION allows people with concerning pasts to infiltrate positions of trust, putting AT-RISK populations—children with disabilities, members of the deaf community, and abuse survivors—directly in harm’s way.
Without certification requirements, there are NO background checks, ethical standards, or training guarantees to weed out unqualified or dangerous individuals.
Other professions, like teachers and healthcare workers, require RIGOROUS vetting to ensure the safety and well-being of those they serve.
It’s time for New York State to do the same for interpreters. Certification must be the standard—not an option—for anyone working in these CRITICAL roles.
By implementing mandatory certification, we can:
• Ensure only qualified and ethical individuals are entrusted with these sensitive responsibilities.
• Protect vulnerable populations from potential harm.
• Raise the quality and professionalism of interpreting services in our state.
THIS LOOPHOLE IS PUTTING MANY LIVES AT RISK FOR ABUSE BY WORKING DIRECTLY WITH THIS MAN. We cannot wait for more harm to occur before taking action.
