The Issue
Homeowners Associations (HOAs) play a crucial role in managing and maintaining the quality of our residential communities. However, there is a growing concern about the lack of transparency and ethical conduct within some of these organizations. Many residents are left feeling powerless, uninformed, and frustrated due to undisclosed decisions and actions taken by their HOA boards. The current minimal oversight allows HOA boards to operate without accountability, leading to numerous instances of misconduct, retaliation, and inconsistent treatment of homeowners.
According to the Community Association Institute, there are close to 7,000 HOAs in Pennsylvania alone (Source: CAI Pennsylvania Community Association Facts & Figures). Yet, despite this large number, there are few standardized requirements for these associations to operate transparently or ethically, including the management companies hired by the Executive Boards of these HOAs. This allows HOA boards to abuse their discretion without any real fear of oversight or accountability.
We believe that it's time for change. We urge the Pennsylvania State Legislature to pass legislation requiring all HOAs within the state to operate with complete transparency—including, requiring the Executive Board to adhere strictly to principles of transparency and ethics. This includes clear communication with homeowners about decisions affecting their properties and fair treatment without prejudice or favoritism.
This will not only foster trust between homeowners and their associations but also ensure that every resident has an equal voice in shaping their community's future.
We urge lawmakers and the Governor in Pennsylvania to support this necessary bi-partisan legislation that will protect homeowners from unethical practices by their HOA boards. It's time we held these associations accountable for their actions and ensure they serve our best interests as intended. If the Legislature, Executive Branch, Local Governments, and others are required to adhere to transparency principles, such as the Pennsylvania Sunshine Act, then so should HOA boards, who have the ability to harass, intimidate, and interfere with homeowners' ability to live peacefully in their own home.
