Mandate Judicial Hearings Before Issuing No-Contact Orders Involving Minors During Divorce Proceedings

The Issue

This is my story. I am a distraught mother going through the exhausting process of divorce since March 2024. Just two months after seeking a divorce, my soon-to-be ex-husband took our two young daughters and evanesively moved to a city over 100 miles away, subsequently filing a no-contact order against me – with zero solid evidence against my parenting capabilities. The court maintains their inability to adjudicate the situation, disputing the stipulation outlined in our divorce paperwork, which clearly necessitates a hearing prior to any major relocation decisions.

This influenced me to take action and initiate a campaign to bring about necessary change. I believe that during active divorce cases, no order of protection that involves minor children should include a no-contact order until a court sets an initial hearing to confirm beyond a reasonable doubt that the respondent – in this case, me, a heartbroken mother – is unsafe and unfit for the children.

This is not just about me and my daughters. It is about every parent in the throes of divorce who is being unjustly kept away from their children based on allegations without proof. It's crucial to note that proven allegations of abuse or neglect should of course lead to immediate protections for vulnerable children. However, unfounded accusations risk tearing apart bonds, inciting unnecessary trauma, and potentially enabling parental alienation.

Let's amend this unjust system. Let's make it a legal requirement to hold an initial hearing affirming the respondent's 'unfit' status before enforcing a no-contact order during a divorce proceeding. Let's keep our courts fair and our children's hearts whole.

I implore you - sign this petition now. Enable change. Help protect the rights of parents and the best interests of our children.
