Mandate Breaks After 6 Hours of Work in Texas

The Issue

We are personal witnesses to the fatigue and exhaustion of working long hours without breaks. As former fast-food workers in Texas, we have gone without a break, tirelessly serving customers for well over 6 hours straight. Why? Because Texas law currently allows businesses to deny workers these critical rest periods due to the ambiguous usage of the word "if" concerning break provision. This dire loophole is damaging workers' health, diminishing their productivity, and undermining their rights.

Research has highlighted the detrimental effects of working without proper breaks on workers’ health, productivity and overall well-being. According to the American Journal of Industrial Medicine, working extended hours without appropriate rest intervals can lead to increased risk of fatigue, mistakes, accidents, and can even elevate stress levels (American Journal of Industrial Medicine, 2015). However, businesses in Texas continue to exploit this murky legal language, putting profit ahead of their employees' welfare.

This petition seeks to rectify this injustice. We urge lawmakers to clarify the language of Texas' labor laws, stating that employers must provide breaks after every 6 hours of work, not just when they opt to do so.
