Mia's Law, for babies inside the womb killed by domestic violence

The Issue

We want Mia's Law to be different from other laws, as she was murdered in a domestic violence.situation .

UNTIL this week, baby Mia was busy growing inside Kirralee Paepaerei’s womb.
At seven months gestation, the healthy little girl had two arms, two legs, and all her major organs. She could kick and punch, and like most babies, probably chose to practise on her mum in the middle of the night.

Her lungs and muscles were developing quickly, and in a couple of short months she would be ready to join the outside world.

Instead, little Mia died in utero on Tuesday, when Kirralee was stabbed to death in her Mount Druitt home.

As any mum knows, the protective instinct kicks in long before childbirth. I cannot imagine the terror Kirralee must have experienced — for her baby as well as herself. The utter desperation to shield little Mia from harm.

Joshua Scott Homann has been charged with the murder of his partner, but faces zero punishment, if convicted, over the death of their unborn baby. In the eyes of the law, it’s as if baby Mia didn’t exist.

You see, in New South Wales, a baby has to draw breath before it is deemed a person.

Never mind the love Kirralee would have felt when she saw her baby’s face in remarkable detail on an ultrasound.

Never mind the fact Mia could have survived and lived a normal life, had she been born prematurely this week.

In our (sometimes messed up) justice system, it seems that pregnancies have little value. That there is no justice for babies like Mia.

Other women whose babies have been killed in utero have tried — and so far failed — to bring about change.
