Make Retirement a Human Right in Kenya's Constitution-Protect 3.6M Elderly from poverty
The Issue
Make Retirement a Human Right in Kenya's Constitution - Protect 3.6 Million Elderly from Poverty
PETITION RECIPIENT:
The Parliament of Kenya
Speaker of the National Assembly
Departmental Committee on Labour and Social Welfare
PETITION SUMMARY
(Short version for main page):
77% of Kenya's 3.6 million elderly have NO pension. By 2050, this will be 12 million vulnerable seniors. We demand Parliament amend our Constitution to guarantee retirement as a human right - just like South Africa and Brazil already do.
THE CRISIS IS NOW
Every day in Kenya, millions of elderly citizens face an impossible choice: beg from family, work until death, or starve. 77% of our 3.6 million seniors have zero pension protection.
By 2050, this will explode to 12 million vulnerable elderly Kenyans.
This isn't just statistics - it's our parents, grandparents, and our future selves.
WHY THIS MATTERS TO YOU
If you're young: Your parents worked hard their whole lives. Do they deserve to retire in poverty?
If you're working: 83% of Kenyans work informally with no pension. That could be you in 30 years.
If you're a parent: What legacy are we leaving our children when they see us abandon our elders?
THE SOLUTION EXISTS
Other countries have solved this. South Africa's Constitution guarantees retirement security. Brazil provides constitutional pension protection. These nations prove it's possible and affordable.
Kenya's Constitution already promises "social security" (Article 43) but lacks specific retirement protection. This legal gap leaves millions vulnerable.
WHAT WE'RE DEMANDING
We call on Parliament to amend Kenya's Constitution to:
- Explicitly guarantee the right to dignified retirement with a state-guaranteed minimum pension
- Create a National Retirement Safety Net Fund for all Kenyans, regardless of employment sector
- Allocate 1% of GDP annually - less than we spend on roads, but enough to end elderly poverty
THIS IS AFFORDABLE
Cost: 1% of GDP (approximately KSh 120 billion annually)
Benefit: Every KSh 1 invested returns KSh 3 to the economy
Funding: Progressive taxation and mandatory contributions (like successful programs in Ghana and Rwanda)
LEGAL PRECEDENT EXISTS
Kenya's High Court has already affirmed that social and economic rights in our Constitution are enforceable (Mitu-Bell Welfare Society case, 2021). Parliament cannot ignore this constitutional duty.
INTERNATIONAL LAW REQUIRES IT
Kenya has signed international treaties (ICESCR, UDHR) that guarantee social security as a human right. We're legally obligated to protect our elderly.
YOUR SIGNATURE = YOUR VOICE
Parliament must respond to petitions within 21 days (Standing Order 225). But they only act when public pressure is overwhelming.
Every signature tells Parliament: "Kenyans demand constitutional protection for retirement rights."
THE TIME IS NOW
Demographic explosion: Elderly population tripling by 2050
Economic opportunity: Create jobs in elderly care sector Moral imperative: Honor those who built our nation
Political moment: Constitutional amendments are possible
WHAT HAPPENS NEXT
When we reach critical mass:
Parliament receives formal petition with all signatures Committee hearings begin within 21 days Public participation across all 47 counties Constitutional amendment process initiated
Victory: Retirement becomes a guaranteed right
