TO THE HONORABLE CITY COUNCIL OF THE CITY OF MOORE, OKLAHOMA:
We, the undersigned legal voters of the City of Moore, State of Oklahoma, respectfully order that the following proposed Ordinance be submitted to the legal voters of the City of Moore, Oklahoma, for their approval or rejection at the next regular municipal election, or at a special election called for such purpose.
Each signer says for himself or herself: I have personally signed this petition; I am a legal voter of the City of Moore, Oklahoma; my residence and post office address are correctly written after my name.

PROPOSED BALLOT TITLE
SHALL AN ORDINANCE BE ADOPTED AMENDING CHAPTER 7, ARTICLE A OF THE CODE OF ORDINANCES OF THE CITY OF MOORE, OKLAHOMA, TO REPEAL THE TOTAL BAN ON THE DISCHARGE OF CONSUMER FIREWORKS BY PRIVATE RESIDENTS; ALLOWING THE DISCHARGE OF LEGAL CONSUMER FIREWORKS ONLY ON PRIVATE PROPERTY DURING SPECIFIED DATES AROUND THE INDEPENDENCE DAY AND NEW YEAR'S EVE HOLIDAYS; ESTABLISHING DESIGNATED HOURS OF ALLOWED USE; AND PROVIDING DEFINITIONS, SAFETY RESTRAINTS, AND SEVERE PENALTIES FOR VIOLATIONS INVOLVING PROPERTY DAMAGE OR NOISE DISTURBANCES OUTSIDE THE ALLOWABLE TIMES?

FULL TEXT OF THE PROPOSED ORDINANCE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MOORE, OKLAHOMA:
SECTION 1: Repeal of Conflicting Sections. Chapter 7, Article A, Section 7-105 (or current applicable sub-section regulating fireworks) of the Moore City Code is hereby repealed to the extent that it imposes a total, blanket prohibition on the discharge of consumer fireworks by private individuals on private property.
SECTION 2: Regulated Personal Discharge Allowed. Private residents within the municipal limits of the City of Moore shall be permitted to discharge legal, consumer-grade fireworks (as defined by Oklahoma State Law Title 68 § 1622) on private residential property, with the explicit permission of the property owner, subject to the following strict temporal constraints:
A. Independence Day Period: Permitted exclusively from July 3rd through July 5th annually, between the hours of 10:00 AM and 10:30 PM. On July 4th, the permitted hours shall extend to 11:59 PM.
B. New Year’s Period: Permitted exclusively from December 31st at 10:00 AM through January 1st at 1:00 AM.
SECTION 3: Safety Restraints, Public Property Ban, and Enforcement.
A. The discharge of fireworks remains strictly prohibited on any public property, including but not limited to city streets, alleys, sidewalks, public parks, easements, and school grounds.
B. No person shall discharge fireworks in a negligent or reckless manner, or toward any person, vehicle, or structure.
C. Fines for discharging fireworks outside of the designated dates and times, or on public property, shall be established up to $500 per occurrence.
SECTION 4: Severability. If any section, sentence, clause, or phrase of this ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions.
