The Issue

My mother, a vibrant woman who unfortunately found herself in a fraudulent guardianship, spent what should have been her peaceful twilight years in turmoil and silence. Deaf and reliant on both her cochlear implant and an iPhone to communicate and access sound, she lived desolately in isolation within a nursing home. These devices were her lifelines to the world, her connection to family and friends through FaceTime ensuring she didn’t feel entirely alone. Yet, they were cruelly snatched away from her. The temporary guardian, in a heartless act of elder abuse, confiscated her iPhone, leaving her in agonizing silence during the last year of her life. Despite filing a lawsuit in federal court, the defense barricaded justice, arguing that only my mother, whose rights were cruelly violated, could lodge a complaint.

This situation is not unique. Every year, countless elderly and vulnerable deaf individuals across the country face similar injustices, losing their primary means of communication and auditory access through coercion or procedural loopholes. Their stories often remain untold as our legal system fails to protect them adequately. The current regulations only allow the affected person to register a complaint, which is inherently problematic in guardianship scenarios where wards, like my mother, are stripped of their voice and rights.

We need a federal law to classify the removal of such crucial communication devices from deaf individuals as a federal crime. This change could serve as a deterrent against heartless acts of removing essential devices from those who are most in need of them, protecting them from psychological and emotional distress caused by isolation.

Ensuring the rights of persons with disabilities, including their access to necessary sound devices, should be non-negotiable and explicitly protected under federal law. The ripple effect of such actions reaches far beyond the individual, impacting family, friends, support systems, and those depending on the ward for support. By compelling this legal change, we prevent not only a gross violation of the rights of vulnerable individuals but also enable their continued participation in community and family life.

This petition is a call to action. It demands that legislators and federal courts take these concerns seriously, fortify the rights of the deaf and vulnerable, and implement a law that recognizes any act of denying someone their necessary communication devices as a prosecutable federal crime.
