This relentless assault on my character has led to a debilitating illness, F.N.D. (Functional Neurological Disorder) leaving me Physically disabled for the rest of my life. This deeply personal experience has opened my eyes to the grave injustices that are allowed to continue in Scotland due to the inadequate legal provisions addressing slander and defamation.
Currently, in Scotland, defamation remains a civil matter, leaving victims to fight long, arduous battles for justice in civil courts, which often comes at a high financial and emotional cost. This creates an environment where perpetrators can act without fear of significant consequences. It is time for Scotland to take a stronger stance to protect its citizens from such damaging acts by making slander and defamation criminal offenses.
Around the world, countries such as Germany and France have recognised defamation as a criminal offense, acknowledging the severe impact these unjust acts can have on individuals and communities. In Germany, for instance, defamation can result in a penalty of up to one year in jail. Scotland should follow these examples to ensure that those who unfairly tarnish the reputations of others are held accountable.
