Here is where the campaign stands this week.
The Colorado CARE Act was legally cleared for the second time by an independent employment attorney with Colorado legislative experience. She reviewed the bill's independence provision - the clause that says your right to a workplace accommodation conversation does not depend on whether you qualify for FMLA or FAMLI leave - and found no preemption problem. Two independent Colorado attorneys. Same conclusion.
Senator Mike Weissman, who chairs the Judiciary Committee in the Colorado Senate, reviewed the bill and confirmed: the lack of immutability is not a legal barrier to protected class status.
The legal argument is won. The political argument is next.

With it we are building a case the Commission cannot set aside.
