Petition updateBody Corporate Corruption, Bullying and MismanagementBody Corporate and Owners Committee

Just a brief update. Over the last several months the owners committee have held THREE meetings in regard to this matter. In the first meeting one member voted in my favour to have the whole claim dismissed (I was surprised by this in some ways but considering how this has all been handled, both by the committee, the BCM and their lawyers, I surmise that perhaps some committee members see just how bad things are and perhaps can see that they could be affected in similar ways).

At the second and third meeting (held about a month ago) the discussion has been that I be given permission to sell my property and negotiate a settlement. None of this at this stage has any legal binding but I am waiting to see what the next move of the BCM will be.

I have always maintained, as per petition, that these people never had a claim against me in the first place. I firmly believe that now I am seeing the BCM and their lawyers backing down (because all along they knew that) and it is my hope that common sense will prevail. Having said that though, I have made it abundantly clear to the lawyers that I will be the one in control of any negotiations. The insanity that has gone on over the years is reprehensible and I will not bend to the demands of the BCM and their lawyers. I have said to them in the strongest terms that if they have a problem with that, THEN TAKE YOUR CASE TO COURT. That is never going to happen. Let's see what happens over the next couple of months.

As a footnote, I advise here that the committee chairman resigned over another more serious matter, which potentially involves the whole complex, and a new committee has also been elected. Unless one really becomes involved in the meetings and how a body corporate is run, most people have little idea of the corruption and misuse of owners funds that occurs. What is happening here is not unique to my complex.

NB. EDIT FOR THOSE WHO HAVE ALREADY READ THIS. I won't change it. I should have said that a new committee is about to be voted for. Some of the current members on the committee have been elected in breach of body corporate law. It is the case however that the previous committee chairman did recently resign. I will keep you posted.
