Asunto: Solicitud de reconocimiento y respaldo al Gobierno Constitucional Cubano para la Transición, conforme al artículo 149 de la Constitución de 1940, para restaurar la República y poner fin al régimen comunista de La Habana
Excelentísimo Señor Presidente Trump:
Nos dirigimos a usted con el mayor respeto en nombre del Gobierno Jurídico Constitucional Cubano para la Transición, única autoridad legítima de la nación cubana, restaurada conforme a lo dispuesto en la Constitución de la República de Cuba de 1940, y particularmente en su Artículo 149, el cual establece la continuidad del poder legítimo en casos de usurpación o ruptura del orden constitucional. Este artículo permite que, cuando el funcionamiento regular de los poderes del Estado sea impedido por la fuerza, los funcionarios legítimos y sus sucesores puedan continuar ejerciendo el poder, aun desde el exilio, para garantizar la legalidad republicana.
Tras el golpe militar de Fulgencio Batista el 10 de marzo de 1952, y la posterior instauración del régimen comunista encabezado por Fidel Castro en 1959, el orden constitucional y la soberanía del pueblo cubano fueron desmantelados. El Estado de Derecho fue sustituido por un aparato ilegítimo de poder que, hasta hoy, continúa oprimiendo al pueblo cubano, sin elecciones libres, sin separación de poderes y sin validación democrática alguna.
Ante esta usurpación prolongada, y en cumplimiento estricto del mandato constitucional, en 1995 fue restablecido en el exilio el Gobierno Constitucional, inicialmente presidido por el Dr. José Morell Romero, destacado jurista y magistrado cubano, conforme a los principios del Artículo 149. El Dr. Morell, reconociendo la necesidad de garantizar la continuidad legal del poder, dejó establecidas ternas sucesionales, en analogía con el mecanismo de sucesión previsto en la propia Constitución.
De acuerdo con esa sucesión constitucional, la presidencia legítima de la República de Cuba en el exilio recae hoy sobre el Dr. Julio Garcerán de Vals, quien fue designado conforme a esa terna sucesional, garantizando la continuidad institucional del Estado cubano bajo derecho. El Dr. Garcerán de Vals ha ejercido desde entonces la jefatura del Gobierno Jurídico Constitucional Cubano para la Transición con plena legitimidad y compromiso con la restauración de la República.
Este gobierno no es una organización opositora ni una creación arbitraria, sino la única autoridad legalmente válida, heredera del orden republicano, y legítimamente facultada para conducir el proceso de transición hacia la libertad.
Solicitamos respetuosamente a usted, Presidente Trump, el reconocimiento formal del Gobierno Jurídico Constitucional Cubano para la Transición como el único gobierno legítimo de la nación cubana. Tal reconocimiento tendría un impacto político y moral de gran trascendencia, al tiempo que brindaría un marco jurídico claro y ordenado para:
Liderar la transición democrática desde el exilio con instituciones republicanas preparadas para restaurar el Estado de Derecho;
Promover, con respaldo internacional, el colapso definitivo del régimen comunista que usurpa el poder en La Habana;
Evitar escenarios de caos o anarquía mediante una ruta constitucional clara y una sucesión legítima.
Señor Presidente, bajo su liderazgo, los Estados Unidos aplicaron políticas firmes contra las dictaduras del hemisferio. Hoy le pedimos dar un paso más: brindar respaldo político, estratégico y diplomático al derrocamiento del régimen comunista cubano, mediante el reconocimiento del único gobierno legítimo de Cuba y el fortalecimiento de una alternativa real basada en la legalidad republicana.
Esta decisión tendría un profundo valor histórico para el destino de Cuba, y representaría también una victoria estratégica para el mundo libre, consolidando su legado como líder anticomunista y defensor de los pueblos oprimidos por regímenes totalitarios.
Confiamos en su visión y en su coraje. La historia sabrá reconocer con honor su papel si contribuye de manera decisiva a cerrar el capítulo más oscuro de la historia de Cuba y a devolverle al pueblo su patria, su libertad y su Constitución.

Subject: Request for Recognition and Support for the Constitutional Government of Cuba for the Transition under Article 149 of the 1940 Constitution to Restore the Republic and End the Communist Regime in Havana
Your Excellency President Trump:
We address you with the utmost respect on behalf of the Legitimate Constitutional Government of Cuba for the Transition, the only lawful authority of the Cuban nation, restored under the provisions of the 1940 Constitution of the Republic of Cuba, particularly Article 149, which provides for the continuity of legitimate power in cases of usurpation or constitutional disruption. This article authorizes legitimate officials and their successors to continue exercising power—even from exile—when the regular functioning of the state has been obstructed by force, in order to safeguard republican legality.
Following the military coup by Fulgencio Batista on March 10, 1952, and the subsequent installation of the communist regime led by Fidel Castro in 1959, Cuba’s constitutional order and national sovereignty were dismantled. The rule of law was replaced by an illegitimate apparatus of power which, to this day, continues to oppress the Cuban people—denying free elections, the separation of powers, and any form of democratic validation.
In response to this prolonged usurpation, and in strict observance of the constitutional mandate, the Constitutional Government in exile was reestablished in 1995, initially presided over by Dr. José Morell Romero, a distinguished Cuban jurist and magistrate, in accordance with the principles of Article 149. Recognizing the need to ensure the legal continuity of the Cuban state, Dr. Morell established succession slates, modeled after the succession mechanism outlined in the Constitution itself.
In accordance with this constitutional succession, the legitimate presidency of the Republic of Cuba in exile is today held by Dr. Julio Garcerán de Vals, who was designated according to that succession slate, ensuring the institutional continuity of the Cuban state under the rule of law. Dr. Garcerán de Vals has since faithfully carried out his duties as head of the Legitimate Constitutional Government of Cuba for the Transition, with full legitimacy and unwavering commitment to the restoration of the Republic.
This government is neither an opposition group nor a product of arbitrary invention. It is the only legally valid authority, the heir to the republican constitutional order, and legitimately empowered to lead the nation through a transition to freedom.
We respectfully request that you, President Trump, formally recognize the Legitimate Constitutional Government of Cuba for the Transition as the only lawful government of the Cuban nation. Such recognition would have profound political and moral impact while providing a clear and lawful framework to:
Lead the democratic transition from exile with republican institutions prepared to restore the rule of law;
Promote, with international backing, the definitive collapse of the communist regime that usurps power in Havana;
Prevent scenarios of chaos or anarchy by offering a clear constitutional roadmap and legitimate succession.
Mr. President, under your leadership, the United States enacted firm policies against the hemisphere’s dictatorships. Today, we ask you to take one more step: to offer political, strategic, and diplomatic support for the overthrow of the communist regime in Cuba through the recognition of the only legitimate Cuban government and the strengthening of a real alternative based on republican legality.
This decision would carry deep historic significance for the future of Cuba and would also represent a strategic victory for the free world—solidifying your legacy as an anti-communist leader and a defender of peoples oppressed by totalitarian regimes.
We trust in your vision and your courage. History will remember your role with honor if you decisively help to close the darkest chapter in Cuban history and return to our people their homeland, their freedom, and their Constitution.
