The Issue

 

Protect American Democracy: A Call for Constitutional Reform to Rebalance Presidential Power

​To: The United States Congress and the American Public

​   We, the undersigned citizens, are united by a profound concern for the future of American democracy. The historical foundation of the United States rests on a deliberate rejection of unchecked authority. Yet, we have witnessed a steady and alarming expansion of presidential power over recent decades, regardless of the party in office.

​   This concentration of power in a single individual threatens the very fabric of our republic. It erodes the fundamental principle of the separation of powers, neuters the effectiveness of the legislative branch, and paves the way for the authoritarianism the Founders sought to prevent. History has repeatedly shown that no single person, however well-intentioned, can be safely entrusted with unchecked authority.

Why This Is Urgent:

1. Erosion of Checks and Balances: The Constitution establishes three co-equal branches of government. An overbearing presidency disrupts this balance, turning Congress from a law-making body into a reactive one and forcing the judiciary into an unsustainable role as the only check on executive overreach.

2. Risk of Authoritarianism: The normalization of unilateral actions—through executive orders, emergency declarations, or unauthorized military actions—creates a dangerous precedent. It provides a toolkit for any future president to bypass Congress and the will of the people, creating a path to dictatorship.

3. Loss of Accountability: When power is concentrated, transparency and accountability vanish. Decisions affecting millions are made behind closed doors, escaping public debate and congressional oversight, which is antithetical to a government "of the people, by the people, and for the people."

Our Demands: A Return to Structural Democracy

​   We cannot rely on temporary legislation alone. We call for permanent, structural reforms to safeguard our democracy for future generations.

1. Initiate the Process for Constitutional Amendments:

   We call on Congress to begin the vital national conversation on constitutional amendments specifically designed to redefine and limit presidential authority. This is the only permanent solution. These discussions must include:

​Reforming War Powers: Restoring Congress's exclusive constitutional authority to declare war and placing strict, binding limits on the President's ability to initiate military action.

Limiting Emergency Powers:       Fundamentally reforming the National Emergencies Act to clearly define what constitutes an "emergency," require mandatory congressional approval for any declaration, and set automatic expiration dates.

Constraining Executive Orders:    Amending the Constitution to clarify that executive orders cannot be used to bypass Congress, appropriate funds, or functionally create new laws.

2. Strengthen Co-Equal Branches (The Democratic Alternative):

To prevent dictatorship, power must be distributed. We demand the strengthening of the branches most accountable to the people:

​Empower Congress: Power taken from the President must be reclaimed by Congress, the people's elected representatives. We demand Congress reassert its constitutional powers of oversight, its power of the purse, and its central role in policymaking.

Protect the Judiciary: We demand measures to insulate the judiciary from political manipulation, ensuring it can function as an independent and impartial arbiter of the Constitution.

​Aggressively enforce its subpoena power against the executive branch.
