Let the Community Be Heard! Do Not Rehire Carter Munday
The Issue
Franklin Residents this is about the Vote to Ratify Improper Hiring of Planning & Zoning Administrator Carter Munday! long read but worth it!! Mind you this is important, If Carter Munday was not lawfully appointed, the community retains the right to challenge prior determinations related to the DATA CENTER!!
Residents of Franklin are issuing this formal public warning ahead of any vote to retroactively ratify the hiring of Planning & Zoning Administrator Carter Munday, following the confirmed failure to comply with required municipal hiring procedures.
The rule of law is the foundation of public governance. When established legal processes are bypassed particularly in positions that directly influence land use, development, and property rights the consequences extend far beyond a single administrative oversight. Such failures undermine public trust, expose the City to significant liability, and call into question the validity of decisions made under an improperly authorized appointment.
Let this serve as clear notice from the community of Franklin:
Residents are actively consulting legal counsel and preparing to pursue all remedies available under Kentucky law, including but not limited to:
• Judicial review of the appointment
• Injunctive relief to prevent unlawful administrative authority
• Examination of actions taken under an improperly filled position
• Taxpayer remedies where public funds may have been improperly administered
Public officials must recognize the seriousness of this moment. Votes cast with awareness of a legally improper process may invite heightened legal challenge and lasting public accountability.
Equally concerning are reported statements attributed to Carter Munday describing engaged community members as an “embarrassment” and “paid activists.” Citizens exercising their right to question government action are not a nuisance they are an essential safeguard in a functioning democracy. These are DOCUMENTED STATEMENTS NOT HEAR SAY.
Franklin residents will not be discouraged, dismissed, or marginalized for demanding transparency and adherence to the law.
This is not political theater.
This is not intimidation.
This is the exercise of lawful civic oversight.
The community is informed.
The community is organized.
And the community is fully prepared to act.
We strongly urge the Mayor Larry Dixon and City Commission Kelly Bush, Jamie Powell, wendall Stewart, and Dale McCreary to pause before taking any action that could deepen the City’s legal exposure and erode public confidence. Not to mention going against what the COMMUNITY WANTS. AND WE DO NOT WANT someone who calls our towns people an embarrassment to be representing us.
The decisions made in this moment will not be easily forgotten nor will they be insulated from review.
Franklin deserves leadership that follows the law, respects its citizens, and understands the weight of public office.
The responsibility now rests with those who vote. We already have our county being sued, no need for the community to be seeking a law suite against the city!
