LENNAR/TROON residents plead to replace Lawncare vendor & bring leadership change!

Subject: LENNAR/TROON residents plead for a peaceful retirement, requesting LENNAR to replace Lawncare vendor, fix all deficiencies and bring leadership change!

Dear Stuart, Fred & Troon leadership:

We, the residents of Medley SouthshoreBay (A LENNAR Community) are frustrated and concerned about the state of affairs at our community for several years now. We sincerely tried to work with your local Tampa management team (from LENNAR & ICON now TROON) but in vain. The lies, the deceit and disrespect from your local leadership is appalling hence this mass petition from we - the residents at Medley Southshorebay. We, the residents are pleading for your intervention to help bring resolution to all outstanding matters and our asks are mentioned in the petition below.

Clubhouse:

There are many challenges at the clubhouse:

  • Due to the removal and elimination of the social director role, LENNAR should stop advertising an active 55+ lifestyle to all buyers/residents because Troon eliminated this role. Conversely, LENNAR must reinstate a full-time social director position to be able to advertise an active 55+ lifestyle without protest
  • Another critical issue is the billing discrepancies with liquor at the clubhouse managed by ICON now TROON. Padding the number of drinks billed and other billing discrepancies along with ever-increasing prices has caused residents to stop purchasing drinks and other items at the club. While we as residents love our community and wish to see the clubhouse flourish, we do not want to be taken advantage hence the clubhouse cannot rise to its full potential. We recommend an audit of the Point Of Sale (POS) systems be conducted by an independent third party that is skilled in detecting discrepancies and revenue leakage. 
  • The new menu prepared by the icon regional manager is full of sugary items ignoring the target audience health. Since the club lacks a commercial kitchen, perhaps a portion of the parking lot should be marked off for a food truck as that would allow for meals to be prepared in a safe and sanitary environment.
  • The beach chairs in the pool area are full of mold.
  • The bar area is not kept in a safe, sanitary condition and is often covered by a thick layer of dust and flies all over the tiki bar. This is an area where food is served and is a health hazard. 
  • The flooring around the swimming pool area is uneven, we as residents can trip and fall. 
  • There is no regular maintenance and mulch all around the swimming pool. 
  • The pool bottom is seldom cleaned and often the skimmer is not on resulting in loads of floating insects in the pool.  Also, there are flies all over the swimming pool area, making it difficult for residents to sit on the beach chairs. 
  • The bathroom facilities at the pool and the clubhouse lack maintenance I.e., Dirty floors, graffiti, deteriorating sink surfaces & dirty light fixtures. 
  • The patio floor near the bar area after a hard rain. The central Florida region sees severe storms six or seven months a year and in rainy season almost every day. The gutter placement is obviously not clearing the water away from the facility and needs to be corrected! This could also account for some of the flies and bugs. The other is an apparent lack of pest control. 
  • The extension to the clubhouse construction has been stalled for many months now, building materials left at the parking lot resulting in limited parking and inconvenience.

Is this the vision of LENNAR? 

OUR ASK:

Since these concerns have been raised to Icon/Troon (Duane Brown) and Lennar (Lori Campagna) for years, we as residents are concerned with leadership qualities and are requesting a leadership change for these critical roles.

Lawncare:

  • Lennar’s HOA manager does not supervise D2E to ensure their contract is properly executed. This leads directly to dead grass in many areas of the community. Likewise, weed control, trimming, fertilizing and other contractual obligations are not met by D2E.
  • Instead of Lennar’s HOA manager protecting the community, she continues to fail the community by placing blame i.e. numerous unfounded claims and blatant lies against the homeowners about disabled Rainbirds
  • Lennar’s HOA manager has turned such a blind eye to the conduct of the HOA’s vendor it borders on malfeasance and D2E’s representative is exploiting this by telling the residents to do their own fertilizers and liquid spray if they want green, healthy grass, refusing to fulfill the contract of putting new mulch each year and asking residents to pay for new 6 inch sprinkler heads because the existing 4 inch heads installed by LENNAR are not reaching common areas, thus dead grass
  •  Common areas are the HOA responsibility not individual homeowners.  Also, since lawn service is part of our monthly HOA fees and the contract is between Lennar’s employees and D2E, D2E blatantly ignores homeowners’ requests for services or exploits the homeowners by charging fees for repairs that should be included as part of on-going maintenance. Especially repairs caused by negligent operation of the mowers and other lawn equipment

OUR ASK:

We as residents request Lennar for leadership change, replacing Lori Campagna and appointing a new HOA manager who needs to begin fulfilling his/her fiduciary duty to the community by releasing D2E and then actually supervising the new contractor.

HOA Financials:

Financials were not published between November 2021 and June 2022. LENNAR’s contracted agent, icon/Troon did not maintain the initial temporary portal, the new portal (stood up in January 2022), and did not communicate the existence of the third portal until there was a large number of complaints from Medley residents. Only after those many residents reached out to Icon/Troon were we finally granted access to the proposed or estimated financials (not reviewed or audited). The financials are not in depth and we as residents are very concerned that the community will be left without sufficient reserves and will face huge-special assessments when construction is complete. Residents have formally requested detailed financials which are required to be reviewed or audited by an independent CPA as per Florida Statute annually.

ARC requests: 

Completing change requests are very frustrating for residents. LENNAR’s appointed HOA manager continues to randomly change the process and requirements residents must meet to be able to make improvements to their homes. Her statements are inconsistent and at times contradictory, approving some refusing others for the same type of change request. This causes extreme delays and undue stress to the residents. Based on architectural control activities over the last year, we as residents are concerned that the current HOA manager does not make decisions in the community’s best interest.

Again, as mentioned earlier, we the residents of Medley Southshorebay are very concerned and pleading with you to bring in leadership change and solutions for a peaceful retirement. We love our community. Lets together make medley an amazing place to live, retire & play!
