The Issue
Lennar Homes is building a neighborhood (initially planned as Austin's Creek Phase 2, but renamed Brightwater) on Grand Palisades Parkway, in the Master Planned Community, The Palisades, which Lennar acquired in their 9 + billion dollar acquisition that resulted in them being the largest residential builder in the United States. Some acquisitions come with expected loss / costs - In Lennar's due diligence they anticipated 3 billion in bad debt. For the homeowners in The Palisades what many were told and sold this was The Palisades would be a 2200 - 2400 home Master Planned Community https://www.theriverdistrict.com/ that included office and retail. We thought and bought many things that simply have never come to fruision https://www.lennar.com/new-homes/north-carolina/charlotte/charlotte/the-palisades Though Lennar has been advertising the community "Brightwater" as a 177 home community in The Palisades, Lennar is now saying this community will not be paying the Master and Residential HOA dues that all other homeowner's in The Palisades are required to pay. This is wrong. Adding Brightwater as is being marketed as a neighborhood in The Palisades would increase the HOA annual revenue by nearly $177,000.00. Lennar has significantly cut back services in The Palisades. Cutbacks, such as landscaping, pool staffing, and adequate HOA staff willing to pick up trash. The homeowners do not have a say in decisions made as this community is fully controlled by Lennar.
