Austin Creek Home Owners - Cap Future Rentals and Allow Representation on HOA

The Issue

Current HOA covenants of Austin Creek in Wake Forest, North Carolina do not restrict the number of homes allowed to exist as rental properties. At this time 17% of the 114 homes in Austin Creek are rentals, the majority of these being owned by large leasing companies operating outside of the state. Of the three existing developed streets, Longmont, Plot Hound, and Austin View Boulevard, Plot Hound alone has 33% of the homes on that street as rental properties, many of which are owned by large home rental companies. Future rentals have no cap and could result in rental companies having the majority representation on the HOA, with homeowners having a minority representation. In addition, current residents have no representation on the board of the HOA which is solely owned and operated by the builder, Lennar Inc.. We the undersigned, being current residents and property owners in Austin Creek of Wake Forest, petition the current builder and sole owner of the Homeowners Association, Lennar of Raleigh and Lennar Inc. to cap the total number of any rental properties in future construction and existing new construction properties at 5% of the total number of homes, including town homes, single family homes, and next gen homes, allowing current rental properties on Longmont, Plothound, and Austin View streets to remain as such. Further, we petition Lennar to follow existing HOA agreement which requires notification to the HOA of intent to sell or rent any home prior to selling or leasing, as currently stated in the HOA. We request the cap become an addendum to the current HOA agreements no later than December 30, 2015. Additionally, we the undersigned petition the Home Owners Assosciation and Lennar for representation on the HOA board beginning January,2016 in the number of no less than two resident owners per 100 homes for the duration of the HOA.
