Legal and Social Recognition of Homemakers’ Contribution to Society

Legal and Social Recognition of Homemakers’ Contribution to Society
The Issue
We, the undersigned, submit this petition to advocate for the rights and recognition of homemakers—women who work tirelessly within their homes without any external assistance. Their labor, though unpaid, is essential to the stability of families and the economy. Yet, their contributions remain invisible, unrecognized, and undervalued by society and the legal system.
Why This Petition Matters:
Economic Contribution:
Homemakers perform essential work, including childcare, elder care, meal preparation, home management, and emotional labor. If calculated in monetary terms, their work would contribute significantly to the economy. A study by the National Sample Survey Office (NSSO) and Time Use Survey India has shown that unpaid domestic labor contributes massively to the national economy but remains unaccounted for in GDP calculations.
Legal Recognition & Rights:
Many women who dedicate their lives to homemaking find themselves without financial security in cases of divorce, separation, or the death of a spouse. Several landmark judgments in India have recognized homemakers' contributions and called for their economic valuation.
Relevant Landmark Judgments:
Rajnesh v. Neha & Anr. (2020) [(2021) 2 SCC 324]
The Supreme Court held that the work of a homemaker must be given equal importance when calculating maintenance. It recognized that unpaid domestic work has an economic value and should not be dismissed.
Kirti & Anr. v. Oriental Insurance Company Ltd. (2021) [(2021) 2 SCC 166]
The Supreme Court ruled that a homemaker’s contribution to the household is equal to that of an earning member and must be considered while calculating compensation in motor accident cases. This judgment recognized the monetary worth of a homemaker's labor in economic terms.
Arun Kumar Agrawal v. National Insurance Co. Ltd. (2010) [(2010) 9 SCC 218]
The Supreme Court observed that just because a homemaker does not earn a salary, it does not mean her services are without value. The court emphasized that domestic work contributes significantly to the economy.
Chanmuniya v. Virendra Kumar Singh Kushwaha (2011) [(2011) 1 SCC 141]
The Supreme Court held that a woman in a live-in relationship who performs household duties and contributes to the family is entitled to maintenance under Section 125 of the CrPC, reinforcing that homemaking is labor that deserves legal protection.
Our Demands:
Recognition of Homemakers as Contributors to the Economy
Include homemakers’ unpaid work in national economic assessments and GDP calculations.
Ensure that government policies reflect the economic value of homemakers' labor.
Financial Security & Legal Protections
Implement laws ensuring fair division of property and assets for homemakers in case of divorce or separation.
Introduce pension schemes, insurance, or monthly stipends for full-time homemakers to provide financial security.
Work-Life Balance & Social Support
Establish government-funded or subsidized daycare, elder care, and domestic assistance programs to ease homemakers' workload.
Launch awareness campaigns to combat stereotypes and emphasize the importance of homemakers’ work.
Ensure homemakers have access to mental health and medical support through national programs.
Call to Action:
We urge the government and policymakers to take immediate action to recognize homemakers' contributions and implement policies that ensure their financial and social security. Homemaking is work—unpaid but invaluable. It is time to give homemakers the dignity and rights they deserve.
