Dear @KirenRijiju @narendramodi what to do when Karnataka officials refuse to act on High Court orders?

In your speeches, you talk about judicial reforms and cleaning up the system. (TOI: Not judges but system at fault, taking steps to improve it: Rijiju on pendency of cases)

Mine is an example of how the legal system is failing miserably at a local level

  • My father (ex-serviceman) purchased a parcel of land in Bengaluru Urban district in 1995
  • Local revenue officials refused to issue the title (Katha) even after registering the sale deed.
  • I took the matter to the Karnataka High Court. Officials contended that the land in the area was under investigation and the Honorable HC order for Writ Petition 46964 (2017) directed enquiry “shall be concluded within six months therefrom.” 
  • Local officials of Bengaluru Urban DC have refused to act on this order.
  • Several of my petitions to the DC and Chief Minister have gone unheeded. (latest meeting notes)
  • I filed an RTI and received an office copy of the file from DC office. A review shows there are absolutely no legal impediments noted and the latest notation says “case posted for order” since May 2021
  • As this is a BJP ruled state, I reached out to a Legal Officer (Lawyer) who is karayakarta of @BJP4Karnataka . He tried to reach out to the minister and officials in vain (Twitter response)
  • After waiting for several years, my lawyer has agreed to file another Writ Petition in Karnataka High Court requesting an action within 3-months

I have been told by several legal experts that the system is broken since local Deputy Commissioners have quasi judiciary authority that is regularly misused. A couple of recent examples in Bengaluru Karnataka

I happen to be an educated techie with access to legal resources. Despite this, I am forced to repeatedly knock-on doors of the High Court. Imagine the plight of ‘Aam Admi’ (common man) with neither the resources nor legal support?
