My five-year-old son now has to navigate his way through thorns because the roadway we've used to access the lake, which has been a public route for decades, is now blocked by an unauthorized fence. This isn’t just a minor inconvenience—it's affecting residents of Lakeview Drive on Greers Ferry Lake significantly. Many of the residents who own property on Lakeview Drive are legally handicapped and rely on easy access to the lake to elevate their quality of life and mental health. The Webster and Hammond families set rules and covenants in October 1971 that established these expectations for all residents of Pine-Oaks Villa. These rules were ignored by Emily annd Thomas Moore when they erected a fence without proper approval of 51% of their fellow neighbors.
The community of Pine Oaks Villa was established with clear restrictions and covenants to ensure peaceful and harmonious living. These regulations require all fences to be approved before installed. Fences particularly affecting shared land access and environmental enjoyment, are to be approved by a majority—51% of plot owners, to be precise. The unauthorized installation of a barrier, such as the fence put up by Thomas and Emily Moore, violates these foundational rules. Moreover, this fence has become a significant obstruction not only to our daily lives but also to emergency services, potentially endangering the wellbeing of all residents in the event of an accident.
The area surrounding Lakeview Drive has served as a communal space since 1971, a shared space that the local population has respected and utilized responsibly. Thomas and Emily Moore's decision to bypass due process and erect a fence without the required agreement not only breaches community trust but also infringes upon the legally outlined use of our cherished land. It's essential to uphold the agreements made and protect the rights of all residents.
