Bukit OUG Condominium Residents' Association (BOCRA) held their 3rd AGM on 30th March 2024.

The issue of the long outstanding Strata Title application was discussed.

Background: PTGWPKL had directed the Liquidators to first apply for conversion of land use from "Residential" to "Residential & Commercial" (Mixed Development) before Strata Title application could proceed, on account of the existence of 74 shops at the CL level. The Liquidators, after some verification and on legal advice, had on 19th Feb 2024 written to the JMB with the proposal to apply to the Courts to void the 74 Shops Sales & Purchase Agreements (SPAs).

The information now revealed were:

1) Original Land use conditions and Planning / Building approvals were "Residential" with no "Commercial" element.

2) The Certificate of Occupation were for "Residential, Car parks and 1 floor of Community Facilities (the CL Level)". 

3) The 74 shops appeared to be wrongly sold by the Developer / PA Holder. 

BOCRA had officially written a letter to "Fully Support" the application of Strata Title under "Residential". There is potentially an equitable way to deal with those ~38 verified Shop Purchasers by way of renewable Long Leases. But JMB ought to claim back the ~36 unverified shops as rightfully belonging to Residents. ("Shops" were listed as part of Common Facilities in the SPAs of the residential units).

JMB could then redevelop / plan a comprehensive shop / tenant mix @ the CL and potentially deriving substantial rental / other income.

BOCRA will work with JMB and Liquidators to ensure follow up actions to resolve the issue of the 74 shops are promptly carried out this year.
