Below is a copy of the letter (in English and Hebrew) that will be sent to the Knesset in the coming days to demand a change in animal rights and enforcement of the law in Israel. The situation is horrific, and only getting worse. It simply has to change, and we are holding the Knesset accountable. Please sign and share among your friends, family and co-workers. The more support, the better chance of making a change. 

We are writing on behalf of Israeli citizens to demand your support to re-address the enforcement of this country’s Animal Protection Law, given the continued rise of animal abuse cases year upon year.

To provide a current example, there is a horse stationed at Allenby/Hayarkon Street in Tel Aviv, which is being used for tourism as a horse drawn carriage. Whilst it took a decade of work by Hakol Chai to succeed in the banning of horse and donkey-drawn carts, this law is yet to apply to tourism. According to Animal Welfare Rights in Israel, it is illegal to work an animal to exhaustion. Yet, two years ago, a horse in a similar situation was worn to death, collapsing in the street amongst onlookers. This needs to change as these animals are being worked to death. Why does Israel deem it necessary to exploit animals in the name of tourism? It’s an outdated trade and like the endless list of countries who have already imposed bans, it’s time Israel follows suit.

In this case we have gathered witness accounts of the physical and emotional suffering of this horse. He is starved throughout the day, provided with no water and remains outside in the blistering heat without shade, with his legs seen buckling under his weight.

Let us be clear, we have, as a group, contacted multiple animal rescue centers and the municipality, all of whom have advised us to call the police. Shockingly, the police have not shown up to take action. And so we, the law abiders, are powerless against law breakers. So too are veterinarians, with only a handful entitled to impose fines to animal abusers.

Humans have the right to be protected. Why should animals not have the same right? Unlike humans, animals cannot speak up for themselves. The Knesset therefore has to step up and speak for them.

We are being forced to take matters into our own hands, and it is not the first time. The case of Alan Morrison viscously beating his dog resulted in the local community rallying to forcibly remove the dog from his custody. It is NOT the responsibility of citizens to put their own lives in danger repeatedly. We are therefore calling for immediate action for this situation to change!

It is a growing concern that law enforcement in this country are themselves breaking the law by not showing up to do their job. In failing to enforce the law, Israel is perpetuating a problem for others to disrespect it, which is an embarrassment to this country and an issue that will possibly lead to a problem for tourists who will be unprotected.

Whilst this country is making leaps and bounds in many fields, we are failing animals at almost every turn. The current lack of law enforcement is a disgrace. In fact, recent findings from a report by the NGO Animals Now found that countless animals in Israel are suffering immensely, and decisions to improve the situation of animals in Israel were not implemented. This report also relays an extensive list of animal abusers who have escaped the law given virtually no regulatory enforcement. Our own country’s leadership is simply ignoring a growing epidemic.

It is our view that action to take full and proper account of animal protection in our law is long overdue. Animal protection is an important ethical and political question, and we have researched the following countries around the world which include animal protection provisions in their constitutions, including the UK, Austria, Switzerland, the Netherlands, Sweden, Denmark and more, all of whom impose harsh monetary penalties, removal of their animals and a lifetime ban, and jail time for acts of animal cruelty and unlawful testing on animals.

First and foremost, as a fundamental principal, animals should be recognized as sentient beings with intrinsic value. We envision the following:

1. A requirement that the government immediately develops laws and enforcement structures so as to afford animals the highest level of protection.

2. Increased and monitored police enforcement of the law and immediate removal of any animal deemed to be suffering from abuse, both physical and emotional.

3. Ownership to the enforcement authorities to be held accountable for their inaction.

4. A requirement that the government develop and support humane education programs to encourage respect and compassion for people, animals and the environment, and recognition of the interdependence of all living things.

5. A requirement that the government and citizens consider animals with respect and treat them with compassion at all times.

It is not enough to just provide a legal remedy. The Knesset has to issue specific instructions to the police and local authorities to enforce the regulations, the same as they do for other laws of the country. Just because the laws apply to animals and not humans, it is no justification for the police to ignore complaints and do nothing to resolve them. Direction has to come from the Knesset which has to monitor the results and make sure proper action is being taken.

We would like to further discuss these proposals, as well as a potential language for inclusion in the law.

Perhaps for the first time in the State of Israel, the people who are following and abiding by the law will be protected.

אנו רושמים בשמם של אזרחי ישראל ומבקשים את תמיחתך בנושא עקיפה, וענישה בכל הקשור להתעללות בחיות תוך התחשבות בעליה הנמשכת של מקרים בהם חיות עוברות התעללות בשנה האחרונה.

קיימת דוגמא עדכנית בא סוס מגיעה בכל יום אל מפגש הרחובות אלנבי והירקון בתל אביב כבסיס לפעילות שלו. בסוס זה משתמשים לצורכי תיירות בו הוא גורר אחריו נגרר אשר עליו יושבים תיירים. בזמן שלקח לעמותת "הכל חיי" כעשור של התעקשות הם גרמו לשינוי החוק והיום חל איסור על סוסים או חמורים לגרור כל עגלה שהיא. לכשזה נאמר חוק זה אינו קיים בכל הקשור לתיירות. כאמור על פי חוק זכויות החיות בישראל חל איסור על להביא חיות למצב של תשישות, ולמרות זאת ישנם מקרים רבים מידי בהם סוסים וחיות אחרות מועבדות עד לתשישות מלאה ובסופו של דבר ומוצאים את מותם בצורה איטית מלאת איסורים. מדוע מדינת ישראל חשה צורך לומר שמצב של ניצול חיות עד לגרימת מוות בתשישות חוקי על מנת לעבוד בתיירות? מדובר באיטם מיושן השייך למאה הקודמת וישנה רשימה מלאה של מדינות אשר התקדמו קדימה ואסרו על מקרים שכאלו ונעשית עקיפה תקיפה בנושא, הגיע הזמן שישראל תעשה כך גם כן ותצטרף לרשימת המדינות האלו.

בנושא הסוס בתל אביב אספנו עדיות על פגיעה פיזית ונפשית בסוס. במשך כל היום הסוס עומד בשמש בשיא החום ללא צל וללא גישה למים, כאשר הוא נראה קורס ממשקלו משום שרגליו אינן עומדות עוד בעומס.

על מנת שניהיה מובנים אנו קקבוצה (מרביתם עולים חדשים ופעלי זכיות לבעלי חיים) פנינו למספר ארגונים שאמורים לעזור לסוסים במצבים כאלו, לעריית תל אביב, ולמשטרה. בצורה "מפתיע" המשטרה לא תרחה אפילו להגיע (למרות שהתבקשנו להמתין במקום) מה שיצר ועדיין יוצר מצב בו אנו שומרי החוק במדינת ישראל חסרי כוח וישא אל מול פושעים ומפרי חוק במדינת ישראל. גם שירותי הוטרינריה אינם מסוגלים לעקוף את החוק ולהטיל קנסות על מתעללים ופושעים.

ישנה חובה בסיסית בה בני אדם מחויבים להיות מוגנים, מדוע אין זכות זו קיימת כלפי בעלי החיים? לא כמו בני האדם לחיות אין את היכולת לדבר ולהגן על עצמן, לכן הכנסת צריכה לעשות חיל ולעשות את מה שמסיבה לא מובנת לא נעשה עד היום, לדבר ולהגן על אותן בעלי חיים.

בעקבות חוסר בעקיפה, איכפתיות וחוקים אנו נעלצים לקחת את החוק לידיים שלנו,ולא בפעם הראשונה. במקרה של אלן מוריסון אשר הרביץ לכלבו באלימות חסרת מעצורים חברי קהילה עזרו והרחיקו את הכלב בכוח, זו לא הארחאיות של האזרחיים לפעול כך ולסכן את חייהם עצמם פעם אחר פעם. אי לכך אנו קוראים לשינוי מיידי בנושא זה.

זו דאגה בפני עצמה כאשר רשויות החוק במדינה עוברת על החוק בעצמן כאשר אינן מגיעות לעשות את העבודה ולא עוקפות את החוק. כאשר אין עקיפה ישראל גורמת למי שרוצה לשמור על החוק לזלזל בחוק ולהבין שאפשר לעשות מה שאפשר ואולי אפילו כדאי להיות לא הגון, לא ישר ולעבור על החוק. נושא זה בסופו של דבר יוביל גם לבעיה פנימית (אשר אנו רואים עליה בפשע כבר היום) ובסופו לפגיע משמעותית בתיירות מכיוון שתיירים יפחדו להגיע מה שיפגע רבות בכללת ישראל.

בזמן שישראל מבצעת קפיצה ומתקדמת במספר רחב של תחומים בכל הקשור לזכויות בעלי החיים ישראל כושלת בכל הזדמנות. חוסר העקיפה בנושא הינה בזיון. למעשה במחקר של ארגוני חיות שונים בעולם נמצא שמספר בלתי מבוטל של חיות בישראל סובלות, וכל מה שנאמר בעבר ודובר על מנת לשפר את היחס אל חיות מעולם לא קרה, לא החל להתרח, ולא ננקטו צעדים שהובטחו שינקטו. דוח זה כאמור גם מתיחס לעובדה שאלפי מתעללים חומקים מהחוק (הם לא פושעי על, פשוט אף אחד לא מנסה למגיע אליהם או איכפת ממה שעשו)מכיוון שאין חוק, ואם יש אז שום עקיפה לא נעשית. מנהיגי המדינה שלנו במילים פשוטות מתעלמים מתופעה שגדלה למימדים שהינה על סף איבוד שליטה.

אנו מאמינים וחושבים שלקחית אחראיות על הגנת בעלי החיים כחוק במדינת ישראל הוא צעד נדרש בצורה מידיית שמזמן כבר היה צריך להעשות. הגנה על זכויות בעלי החיים היא אמירה אתית פוליטית ואנושית.מדינות נוספות בעולם כגון בריטניה,אוסטרליה,שוויץ, הולנד,שוודיה,דנמרק ועוד, בכולן ללא דופי ישנה עקיפה וענישה קשה מאוד הכוללת כלא,קנוסות גבוהים מאוד, לקיחת בעלי החיים מהמתעללים, והחרמה ובידוד לכל חיים של אלו שהתעללו בבעלי החיים.

כצעד ראשון בעלי חיים חייבים להיות מוכרים כחלק ובעלי ערך בחברה הישראלית, אנו מאמינים ודורשים את נקיטת הצעדים הבאים:

1-    חקיקת הממשלה ופיתוח חוקים אשר יקנו לבעלי החיים מעמד אשר בו ניתן להגן עליהן בצורה המיטבית ביותר.

2-    הגברת העקיפה הכוללת ניתוק מידי בזמן אמת של החייה מן המתעללים בא- אם מדובר בהתעללות נפשית או פיזית כאחד.

3-    נטילת אחראיות ונקיטה נגד רשויות החוק במקרה של זלזול, חוסר מילוי תפקידם, התעלמות וכל דבר אחר בו אינן משרתות, מגינות ועקפות את החוקים (כפי שלצערנו שמתרחש כיום ביותר מידי מקרים).

4-    דרישה ובא הממשלה תבנה,תיצור ותקנה תכנים חינוכים בכל הקשור בהכרת, הבנת ופיתוח ידע בנושא הגנה על בעלי חיים, והבנה שבעלי החיים תלויים בנו במקריים רבים ואין לנו לנצל זאת לרעה.

5-    דרישה ובא הממשלה ואזרחי מדינת ישראל יתיחסו בכבוד לבעלי החיים בכל זמן.

אין זה מספיק בחקיקת חוק, חוק אינו תרופה. חייבים לנקוט בצעדים משמעותים, להוציא הוראות ודרכי פעולה ברורת וחד משמעותיות לרשויות החוק, עריות מקומיות על מנת שיעשו שימוש בכלים שיש להם ויעקפו את החוקים הקשורים להתעללות בבכלי חיים באותה הצורה בא הם עוקפים את שאר החוקים במדינץ ישראל (אמורים לעקוף). רק משום שחוק כל שהוא קיים לגבי בעלי חיים אין זה אומר שהמשטרה יכולה לזלזל ולהתעלם מקריאות פעם אחר פעם ולעשות כלום ושום דבר על מנת לפתור את הבעיה. הוראות חיבות להגיע מן הממשלה, ועל הממשלה לוודא שהוראות אלו מולאות, אם אינן מולאות על המפירים לשלם את המחיר.

אנו מעוניים להמשיך ונהל דיון נרחב בנושא ולכלול שימוש בשפה מסוימת בחוק.

אולי בפעם הראושנה, לשם שינוי אלו ששומרים על החוק (גם אם לפעמים פחות נעים) יהיו מוגנים  על ידיו.
