WE DEMAND YOU TO BRING JUSTICE
We, the family of the late Mr Gabriel Phillip Sakari, a beloved son, brother, nephew, husband, father and uncle. He was a Business man, farmer and social worker, helped in looking after his mother who suffered a stroke 4 years ago, a human rights activist in Youth Affairs, worked at Soy Aids Resource Center as a community Aids mobilizer in 2005 - 2006. He was actively involved in Youth programs at District, County and National levels, and was aspiring to run for the MCA (Member of County Assembly) office in 2017. He used his political influence to aid community development and defended the rights of the Kenyans /local citizens. He was known to many as Honorable Gabriel Sakari and at 34 years old, his life was brutally ended, leaving behind a young wife, daughter and son.
On the 25th of December 2015 Hon Gabriel Phillip Sakari left his wife preparing Christmas dinner and joined his cousins, nephews and friends, about 12 people in total, at Freenie Wines and Spirits Bar in in Furfarol, Kongoni area near Matunda for a few drinks. He had also invited the barman at his house for christmas dinner as he lived alone with no family.
At approximately 10PM, a woman who was being physically assaulted by her husband, Mr Daniel Kiplangat Sang, ran into the bar screaming for help. Mr Sang rushed in shortly after her and slapped her several times (3-5). Hon Sakari and other males intervened and separated the couple. Mr Sang then grabbed his wife and dragged her out as he got to the door he warned them, “I will be back”.
Hon Sakari, family and friends carried on drinking not taking the threat seriously, until a few minutes later when Mr Sang’s wife rushed back into the bar and told them her husband was coming back armed with a bow and a quiver of arrows. Thinking that Mr Sang wanted to shoot his wife, Hon Sakari stood up and went towards the door to broker peace and plead with Mr Sang not to shoot his wife nor use the weapon. However, as he stepped out of the door on to the veranda, Mr Sang shot him from close range, on the left side of his rib cage. He pulled out the arrow, showed to family and friends and cried, “I have been shot with an arrow.” His last words before collapsing on to the veranda floor. Hon Sakari was rushed to Matunda Sub-County, where he was pronounced dead on arrival at the hospital 20 minutes later and taken to Moi Referral hospital morgue in Eldoret. The postmortem results revealed he had suffered a punctured lung and his heart was sliced almost in half. The doctor in charge of the postmortem examination, told family members and the two Criminal Investigation Department (CID) Police Officers that he would not have survived even if he was shot outside the hospital.
As you may know, Hon Gabriel Sakari’s murderer has not yet been arrested or charged for this crime. We have been told by locals that Hon Sakari was Mr Sang’s 4th victim, all of whom have been killed with a bow and arrow. He also was arrested and placed in Police Custody at Matunda last year, for sexually exploiting a child, a pupil at Mobet primary school where he taught and Mr Sang impregnated her- she is his current wife. A case which was reported to the police by his concerned fellow teachers and locals. This case was settled out of court with the girls family receiving a ransom and Mr Sang freed and allowed to continue working with vulnerable children by the Matunda police. This was followed by a suspicious death of the deputy headmaster, at Mobet Primary School by food poisoning, Hon Sakari’s murder and at Mobet Primary School, (the same school) where Mr Sang also violated and impregnated another child.
These crimes that could have been avoided had Matunda Police enforced Law in the 1st Child abuse case, in which Mr Sang was arrested but was not charged and faced no punishment or retribution for his acts.
Your Excellency Mr President, we call for this police decisions to be reversed and Mr Sang to be re-investigated, re-arrested and charged and punished for this crime. This calls for proper investigation by a competent, non-biased police officer from a different region and not answerable to current Matunda OCPD OR OCS or The Kenyan National Intelligence Service Officials only, (and face maximum sentence permitted under the Law for these sort of crimes he committed), not Matunda Police as we believe that malice and indifference shown clearly by the OCS and OCPD- the 2 Senior Police Officers. This murder deserves the attention and resources of the Kenyan Government and that no other local courts or governing body to have jurisdiction to prosecute this case other than the High Court.
We believe that the level of Police abuse, manipulation, failings, mistakes, discrimination and incompetence shown by these two most senior police officers at Matunda Station, warrants a High Court case for capital punishment/ murder 1 criminal charge as Mr Sang’s actions were premeditated, and did not just stop at assaulting his young wife. He went back to his house and returned to the bar with an assault weapon, not only shooting at Hon Sakari but also at others who came to Hon Sakari’s aid. Mr Sang should face the most severe punishment for taking advantage of, bullying and cajoling young, primary school children into having sex with him. And if investigations confirm what the public and some police officers have told us about Mr Sang being a serial killer and a child molester at his places of work. Then we demand Mr Kiptum (OCPD) the Matunda OCS be investigated for their part in this Murder, other murders and children sexual crimes in our local community ranging from poisoning, stabbings, and use of assault weapons.
The 8 murders pointing at Kalenjins (Mr Kiptum’s tribe) in our local community as murderers and why none of the suspects/accused, (Kalenjins) have been prosecuted and jailed/punished for these murders according to the Kenyan Law. These two senior police officials, if found guilty of abuse of public office/duties should:
- be stripped of their titles/demoted
- be retrained
- and work under the supervision of a competent, senior police officer
- or be sacked and face jail sentences if found guiltyof having put Kenyan citizens lives in danger/risk.
Your Excellency Mr President, Any criminal proceeding should be brought to the High Court if not the Magistrate Courts other than in the Rift Valley and which are held responsible for hearing capital cases that are unjust and unconstitutional.
Your Excellency Mr president, we implore you to support the arrest of Mr Daniel Kiplangat Sang, for the murder of Hon Gabriel Sakari, and investigations into his previous behavioural track record both as a Kenyan citizen and as a teacher. We implore you to assign competent, non-bias police officers, from a different location or The Kenyan National Intelligence Service Prosecutors to this case(s) and allow them to seek indictment for this murder and Mr Sang’s previous murders, if any (and the 8 murders committed in Kongoni, Furfarol and Matunda areas), and for child sexual offenses. Please bring Hon Gabriel Sakari’s murderer and others to Justice. We ask the competent police/ National Intelligence Service Prosecutors to have the courage to address the terrible wrong done to our family and other families and equal wrong done to Kenyan citizens when faced with Police negligence, incompetence, mistakes and abuse of power given to them under our Constitution, which often goes unpunished and unanswered. And which has cost a life/lives, compromised children safety and put them at risk and increased crime and tribal tensions in our local communities.
We, the family of Hon Gabriel Sakari , our friends and the residents of Likuyani Sub County are appalled by the brutal and unjustified murder of Hon Gabriel Sakari, who stood up for peace, justice and human rights of all residence regardless of gender, age, tribe, status etc. We are all horrified by the lack of mercy, lack of decency and lack of honour displayed by Senior Sworn Law Enforcement Officers in Mr Meshach Kiptum, Officer Commanding Police Division at Likuyani Sub-County, and the Officer Commanding Matunda Police Station, whom my family met on several occasions in regards to progress made for the arrest and prosecution of Mr Sang, but were unfaithful as were told by Mr Kiptum - that Mr Sang had called him and told him he was on his way to Uganda to escape arrest and murder charge. Another time, Mr Sang’s mobile phone signal had been picked up in Naivasha and CID officers in Nakuru and Naivasha had been assigned to raid the location and arrest him, only to be told a few days later that Mr Sang was on a prominent government official’s farm in Naivasha and could not be arrested from there. This is after Hon Sakari’s father had confronted the OCS and asked why Mr Sang had not been arrested when he was still using his mobile phone to contact people at Furfarol, his wife and his family. The OCS, asked Mr Sakari’s father how he knew that Mr Sang was still using his phone, which obviously he could not tell. Adding insult to injury, Hon Sakari’s family were told by Mr Kiptum that Mr Sang was not from around Furfarol (but from Baringo), and when asked about his previous crime record he said they were not aware as Mr Sang had been transferred to Mobet Primary from elsewhere. Negligently, Mr Kiptum tried to assure Mr Sakari’s father and brother that Mr Sang will eventually be arrested even if it meant 10, 15 or 20 years later.
Sources at Criminal Investigation Department (CID) Head Quarters also told us that their boss was sitting on this case, meaning the Inspector General of Police, who is said to be related to Mr Sang. At Nation Press Head Quarters, We contacted a Ms Cherono, who refused to publish our story naming Mr Daniel Kiplangat Sang as the murderer. Police Interference is evident, and CID Headquarters were also unwilling to help and asked Hon Sakari’s family to use the media channels, which already could not help. We ask, again, that if Police failed in their duty to deter and prevent crime and to protect Kenyan citizens from the repercussions of crime, due to corruption, bribery and tribalism or for whatever reason, that Mr Kiptum, the OCPD and OCS be removed from Matunda with immediate effect, be stripped off their titles and be sent back for retraining, after which they should be assigned to work under supervision of more competent senior officers, and or even be sacked and face jail sentenses.
We implore you, your Excellency, Mr President to assign a non Kalenjin/Nandi (neutral) OCPD and OCS, that are competent and non biased so that they can restore peace, safety and faith in the police and legal system back in our communities, and also to correct the mockery to our justice system that has led most reasonable people to believe that our justice system is completely and perhaps hopelessly corrupt, that there is no Justice whatsoever. And that police play judge and jury choosing which criminal to prosecute and acquit should not be tolerated for it has no place in our communities and country.
These are moments for our entire nation to become educated in this sort of police negligence on tribal grounds. It is unbelievably dangerous and really takes us to a situation where the rule of law is beginning to erode on our streets and communities, and vigilantism is being actively encouraged by this police abuse of powers given to them and manipulating the Law for their own gains.
Murder is unlawful killing with malice aforethought of another human being and generally this premeditated state of mind distinguishes Hon Gabriel Sakari‘s murder from other forms of unlawful homicide (e.g. manslaughter or accidental death).
Mr President, you are our only hope to get justice, please do not allow this brutal act to further weigh on the conscience of our community and nation. Please act now and right this terrible injustice.
