Kelly's Law: Extend the limitation period for NHS negligence claims for unwell patients
The Issue
In 2013, I underwent a medical scan that revealed a growth on my thyroid. Unfortunately, I was not informed of this significant finding. It wasn't until seven years later, in 2020, after continued poor health, that an MRI scan showed a large growth on my thyroid. Upon reviewing my medical history, the earlier scan clearly indicated the presence of this growth, yet this crucial information was never communicated to me. In October 2020, due to persistent health issues and a diagnosis of Graves' disease, I had my thyroid entirely removed. Post-surgery, the thyroid was biopsied, and it was discovered to have papillary carcinoma—a form of thyroid cancer.
This grave oversight in my medical care has not only affected my health but has severely impacted my life. However, the current limitation period for NHS negligence claims means that many individuals like me, discovering medical errors years later, are left without legal recourse or justice. The statute of limitations typically requires claims to be made within three years from the date of knowledge or within three years from the incident. This restrictive timeframe is particularly unjust for individuals who, through no fault of their own, are not well enough to make a claim.
I have been unable to make a claim due to it being over three years since I found out about this lack of transparency regarding medical findings. In the three years, I have had numerous operations and treatments along with full mental breakdown but this is not enough to get the limitation period extended even under exceptional circumstances. I feel this is wrong.
The importance of extending the limitation period for NHS negligence claims cannot be overstated. Many health conditions may take years to be accurately diagnosed, and in some cases, medical errors are only discovered much later. Revising this limitation period will ensure patients have a fair opportunity to pursue claims against negligent medical practices and seek deserved compensation and accountability.
To effect meaningful change, we propose the following actions:
1. Extend the limitation period for negligence claims to at least 10 years, also make the exceptional circumstances criteria allow patients that have been and proven to be to medically or mentally unable to make their claim. It is only fair to allow adequate time for patients to discover medical oversights.
2. Implement mandatory protocols for health care providers to review previous test results which may have been overlooked.
3. Enhance patient communication and documentation practices to safeguard patients' rights and ensure transparency and trust in healthcare.
