
The Racial Justice Act is a California law passed in 2020 which prohibits the State from pursuing convictions or sentences based upon race, ethnicity, or national origin. The law allows people to challenge any proceeding that may have been infected by racial bias. This law allows those convicted to have their cases revisited by the District Attorney and even the State.
In the case of Kerry Baxter Senior all of the black jurors were struck. The DA was allowed to paint Kerry Baxter Senior as a Drug Dealer Gang Member and as unemployed. None of the accusations were true nor did they have anything to do with why he was on trial. At the time of his trial Kerry Senior did not live in Oakland was 32 years old and was employed. He was accused of being a Gang Member of a Non existent Gang in Oakland. No evidence of him being guilty of the crime he was accused of was presented instead after being out 10 days the Jury was about to deadlock. The Judge told them that a Police officers word carried more weight then the defendant. The Police Officer they were referring to was allowed to introduce testimony from Kerry's girlfriend who was not present for the defense to cross examine.
They needed a conviction of a black man in Alameda County to make the OPD the DA and the courts look legitimate. It was a modern day lynching and to make it worse they have allowed Kerry Senior to have his prison files give him a gang enhancement. That means he is sent to the worst prisons in the most remote areas to make it impossible for his family to give him the support that he needs!
We want our loved ones locked away with Wrongful and Disparate sentences home!!
