When Kerry Baxter Senior was arrested in April of 2001 he was a Journey Level Carpenter and Pile Driver. He was scheduled to work on the Bay Bridge as soon as the rain stopped. The Oakland Police Department and DA's Office knew he was employed and that he had a family and lived in Berkeley. Yet they made sure charges were piled on and his bail was so high he would remain in Jail. He sat in Santa Rita 2 years due to the High Bail of $2,000,000.00. While the person who had attacked him and was given blanket immunity to testify against him stayed on the streets of Oakland robbing and assaulting people including his girlfriend. 

Kerry was continually denied a speedy trial and was given the same public defender as the person who attacked him. When he asked for another attorney because his attorney was also representing the person who attacked him he was ignored. We put together $15000 to get him a private attorney and that too was a mistake because the attorney we hired was connected to the Judge. He went in as a friend of the Court and did nothing to defend Kerry. He had solicited Kerry at Santa Rita and told him he could get him off. The other attorneys wanted at least $25000 to even look at his case. The attorney was being disbarred but because his father had been a judge at the same courthouse they allowed him to misrepresent Kerry Senior. They must have had a good laugh at our expense knowing what we did not know that the Attorney was being disbarred. 

Kerry did not have a trial it was a public lynching to let any other black person coming through that court whether guilty or innocent that they better take that plea. The Oakland Tribune played it up and printed every lie the DA told them and refused to refused to quote Kerry's family. He was a taxpayer a family man and a citizen whose right to a fair trial was denied. No he was not a 31 year old man who worked raised a family and had time to be a Gang Member. That is and was a lie but the DA and OPD and CDCR put a Gang enhancement on his prison record so that he is put in prisons that are at least 100 miles from us his family!
