On December 7, 2024, Xavier Aquaine ‘Niah’ Foagh, a 23-year-old Jamaican father and rising music artist, was murdered while livestreaming on TikTok, just days after being threatened in recorded voice notes. His death was not random. It was calculated. 

Before his death, Niah received multiple extortion demands and death threats, including explicit warnings that he would be killed “anywhere he went live.” Since his brutal murder, his family and closest friends have endured daily threats, harassment, cyberbullying, and psychological terror from the same individuals believed to be responsible, all while grieving his loss.

 

What is at stake?

If nothing is done, we are sending a dangerous message to the world: 

·      Violence livestreamed online can go unpunished.

·      Online threats can become real-world executions.

·      Even victims who cry out for help can be ignored while the authorities look the other way.

 

 We risk normalizing digital terrorism, silencing witnesses, and allowing criminal influence seep deeper into law enforcement. 

Allegations of corruption point directly to the Old Harbour Police Station, where an officer known as “Jigga” is believed to have tipped off suspects before raids, obstructed investigations, and silenced the truth. If this case is buried, it sets a precedent: that criminals can buy protection, silence victims, and escape justice.

This is not just a failure of justice. It is a failure of humanity. 

 

Why is now the time to act?

Nine months have passed. No arrests. No accountability. No answers. 

1.        The family continues to cry out. 

2.        The threats continue.

3.        The suspects continue to post and profit. 

This case has crossed borders and platforms, from the streets of Old Harbour to social media feeds worldwide. 

 

We cannot wait until another young life is taken on camera while people watch in horror.

What we are asking for.

We urgently call on Prime Minister Andrew Holness, the Jamaican Constabulary Force, United States authorities, including the FBI and Homeland Security Investigations, and the U.S President, Mr. Donald J. Trump, to take immediate action.

 

1.        A  full criminal investigation into Rushane “Crush Bread” Simms and his associates for their alleged role in the threats and murder

2.        An internal investigation into the Old Harbour Police Station for corruption and protection of the accused

3.        Guaranteed protection for Niah’s family and friends who are still facing credible threats

4.        Accountability for social media platforms, especially TikTok for amplifying and profiting from threats, intimidation, and monetization of violence

5.        The establishment of an international framework to address digital crimes and livestreamed threats

6.        President Trump to use his influence and global platform to bring attention to this case and pressure authorities to act, ensuring that justice cannot be ignored or delayed.

 

If these actions are not taken, we risk sending a message that online threats, extortion, and livestreamed executions can go unpunished. Justice for Niah is not only about one life lost. It is about protecting every future victim from the same fate.
